Subject: Want to move to Canada
My fiance and I have been together for 3 years. He is Canadian, I am American. He has moved to Colorado twice to be with me on a TN Visa. His parents passed away so he moved back to BC to be with his brother, sister, and family. He has a great job and recently bought a home. It´s unrealistic for him to move back to Colorado and we want to move me there, yet, won´t be married for another year and a half. Is there any way I can get a Visa and live/work in Canada until we are married?

Tough scenario...

Realistically there isn´t much likelyhood that you can live up there until you´re married. Sure you could come up on a visitor visa for 6mths, but during that time you cannot work or go to school.

My recomendation, since I was in a similar scenario... Elope now and move up there. Once you´re married you will be given a 1 year Visitor Record; during which time you will have to apply for permanent residency.

It is best not to live up there saying you are a visitor [unofficial], they will figure it out and tell you that you MUST change your status or you will not be allowed back into Canada.

Just remember it takes quite a long time to get permanent residency so its best to get the ball rolling sooner than later. I applied for mine in December and I am hoping to have approval in principle by June. Thats a long time without work.

Alternatively... if you are offered a job and it is covered under NAFTA you could get a work visa at the Port of Entry and work and live up there. If it is not covered under NAFTA it will have to be confirmed by HRDC, and in all likelyhood will be rejected on the grounds that a Canadian could fill that job.

Good Luck!

Cheers
