Hi,

My parents submitted their visitors visa documents to VFS mumbai, but unfortunately their visa got rejected, saying they did not show enough proof of their family-ties back in India. If they were to re-apply, what are the chances of them getting the visa? Also, do you think it is better to go through an agent or a lawyer?

Please advice.

a lawyer would not help. you are caught in the same situation many others are... CIC is seeing little motivation for your parents to return home at the end of their visit and CIC does not want to risk having your parents overstay their visa - becoming illegal.

do your parents own property, have a business in India that would prompt them to return? They have to find a way to prove they will go home.

A good way is to present a good case. Have them at least book their ticket (not buy) to show when they want to come and go back.

Also a letter from you undertaking their visit helps. This shows that you and your parents really are planning this as a visit.

Last but not the least documents such as property, bank statements, retirement accounts in India itself.

If all fails - then I guess only thing that remains is to actually sponsor them for PR. It is sad that so many PRs actually happen not because they want a PR but out of no other option to keep in touch with their family, as in your case.

Thankyou for the instant reply. Actually, we did send all the possible documents both from our side and their side, from bank statements, flight tickets (including the return tickets) to property documents and pension documents. We are very disappointed this did not work out :(
The only thing we can think of now is to re-apply for their visa. Do you think going to Delhi and having a face-to-face appointment with the Consular officer will make a difference? Any other solution?

Please help.

No, I don?t believe a face to face interview is going to work. I believe only the applicant is allowed to enter for visa interviews.

With all the documents you have submitted - I?m surprised at them rejecting the visa. What they look are enough ties to home country which you have shown.

Can you share what questions besides general questions they asked your parent?

What you can try is apply through a travel agent - they charge about 1000 Rs to get these done and know what needs to be done to apply a good application.

A letter from your local parliament member may also help.

Also try to apply this time for a shorter duration - i.e a month and half maximum. When they have some one time; they may get a longer stay visa next time.

Also try and order their visit visa file to identify exactly why was the visa rejected.

Well, they submitted their documents to the new VFS mumbai center. They were not asked a single question when they submitted the documents. And within 2 days they got a courier, with their passports and a letter stating "the consular officer is not convinced they will come back" and the case is closed. Its really sad, as I said we submitted all the supporting documents..don?t know why they rejected it.

What was the question asked?
Try to order the visa file. You as a Canadian can order it for 5$

It will have the alarm flag for future application.

My parents had same problem, I asked them to get the US visa and than they went to the Canadian consulate, they got it last year.

I think the only option is to apply again. Result might vary depending on the scrtunizing officer. And highly recommend a face to face interview. That way you can guide the official to the property papers etc. which would prove to be a compelling reason to return. By the way r u a PR in Canada??

Immigration officers are not trained to be haman at all, my wife?s visitos visa was also rejected two times, altough we submitted all document...
so, we are now applying for the spousal pr visa.

Well, I am here on a work visa, and have applied for PR, probably it will come by year end. Why, do we need to have a PR, in order to invite them?

Well you come out with details one step at a time. I asked you what question they asked your parents? You never replied.

We are just contemplating.

For e.g. I´m on a F1 (student visa) in the US however my parents have come from India 2 times to visit me. And they simply mentioned they wanted to visit me. They even got visa to goto Canada (we have relatives there) and the UK on both occassions. Infact the second time the embassay themselves recommended them to take long term visas.

However, they have traveled extensively before these two times. It is all about case to case and trust you can show to the agent. If you show that you are going to return then they have no problems to issue you visa. You were here on work visa and now are applying for PR; the next step naturally will be PR for your parents. What if they decide not to return? They may say we are not medically fit. All these questions have to be proven to the immigration officer. Remmember the burden of proof is on the applicant and not on the officer.

How long did you ask the visa for? Try to get the first time for three weeks visit. Then maybe next time for longer duration.

Do you have relatives elsewhere? Try to get a visa for some other country now before you apply for Canadian visa. However make sure you don´t apply for more than 3-4 weeks stay this time.

something to think about...you have indicated you want to stay in Canada after your work permit. Did you use the work visa to gain permanent entry into the country? CIC would probably want to know! If you were still only with a work permit - the visitors visa might be easier because everyone intends on returning to India- including you.

Why are you so desperate to have your parents visit? I am sure immigration would love to know. It is far too easy for people in this situation to simply forget where they put their return plane ticket. You cannot say it would never happen... it happens more often then CIC even wants to think about. So instead of going through the trouble and expense of finding those who forgot to go home...they simply say no in the first place. Much easier.

In speaking to my MP about visitors visas (my fiance has been turned down 3 times), he tells me the following. Immigration officers must put their name beside every visa that is issued. If a visitor does not return home, it goes against that particular immigration officers record and affects his job security. This is done so an officer is less likely to be bribed to issue travel documents. If an officer has doubts... he is highly motivated to protect himself and will decline the visa.

Good luck, but do not be too hopeful.

Because of your explanation.... I can understand why immigration officers must be more considerate when they issue the visitors visa... they are getting look like a human for me...
Nevertheless.... I think they have to issue the visitors visa to whom are married Canada PR or citizen not to give pain to them.... and they´d better strengthen the purnishment to fake marriage people..

I would not want the job of an immigration officer for anything. I am guessing that there are equal numbers of those who get away with spousal immigration fraud as those who are denied for legitimate reasons. there must be a very big grey area that is simply a judgement call by the immigration officer. Like I said... I would not want their job for anything..

Hi,

My relative´s TRV was rejected two years back and she will try agian to get TRV next month. It was posted earlier that it is possible to get the visa file for $5. Could some body tell me from where I could get the visa file? I would like to see this file before my relative applies for TRV agian.

Other thing: these days I heard some people signing the bond agreement worth of $50,000 as part of a guarantee that person they are sponsoring will go back to India before his/her visa gets expired. Is this bond signing a real requirement for TRV or it is just a overkill?

Hi,
My visitor visa application turned down today with same old and famous reason - " i will not return to india and blah blah...."

the person who invited me was a canadian citizen and own a house in canada. ALso they are self employed in canada with a very huge assets to show which they did.

on my part, i also showed last 6 months bank statement and house property papers.
i motto was to visit and return back.


can any one tell me how to convince the foolish officers sitting in high comission that we are literate and good ppl who wants to visit relatives and see a foreign country and not flood their country.

pls reply me how can i get visa, and in how much time shall i reapply.??
