Subject: Dual citizen gr
  Hi there - this site is very informative.

I have what appears to be a unique situation, as I can´t seem to locate any real information and even Canadian Immigration can´t give me a straight answer.

I was born to a Canadian mother and American father in the US and, therefore, was able to prove and receive my Canadian citizenship a couple of years ago.

I have always lived in the US but now my American wife, my dual-citizenship son and I are planning to move to Montreal very soon. I thought this would be no problem, but I am starting to get worried thinking about all the red tape and after speaking with Immigration. I´m waiting on a call back from them, but it´s now been several days so I´m just wondering if anyone else has been through this or could provide any reassurances or advice?

Is your concern for you or your wife?
Also, are you concerned about loosing your Am. Citizenship or just that your Canadian citizenship will be honored.
From what I can tell, if you can prove your Canadian citizenship with a passport or birth certificate, then how could there be any complications? You have what many of us are hoping to obtain.

Thanks for the reply Greg. I´m not too worried about my long-term ability to get over the border but I´m not sure I´ve got all my ducks in a row as I start to find information about declaring the value of any goods obtained while abroad (in this case, my whole life). Our plan was to move in the beginning of May - my wife and son would fly and I would drive over with a little UHaul carrier.

A possible problem can be your duty as a citizen. Did you file taxes for Canada while you were Canadian citizen and living in the US?

However, this is not a biggy - they can´t derive you of your right as a citizen for this point. However be prepared to answer that

not sure you can simply have your wife and family move with you. They do not have status in Canada. I believe you will have to sponsor them.

I agree with Sharon. You are no problem, but your wife and child cannot simply move to Canada. Your wife needs to be sponsored by you. I was sponsored by my wife and it took me six months to get a visa. If your child was born in the US, he will need to get proof of Canadian citizenship from a Canadian consulate. My wife did this for our kids and it took several months to get their Canadian citizenship cards.

From my conversations with Canadian customs, you would need to pay duty on a certain amount of the goods you brought it. I don´t remember what it was, but customs is much easier to phone and get information from than immigration is.

The good news is, if you wife is granted a visa, she would be able to bring an unlimited amount of goods in as an immigrant. So you simply declare everything in her name and owe no duty.

I forgot one piece of important piece of information. If you are sponsoring your spouse, it is possible for you to submit the forms at the border when you enter Canada. You need to have all the forms completed, including police/FBI certicates and medicals. When you enter Canada you submit the forms to the immigration officer and pay your fees (including landing fee). They are checked for completeness and then you are all allowed to enter. While the case is being processed, your wife would not be able to work (unless she was able to get a temporary work permit by some other means).
