Subject: Illegal in the US want to migrate to Canada
  HI,

I´m a US citizen and have applied for my husbands Green Card in the States. However, due to US immigration lack of efficiency we have been at this for over 5 years. Now my husband has even lost his work permit and US immigration wont answer. We are sick of waiting and willing to move to Canada. We are both educated and would qualify under skilled Workers.

Will we even have a chance, now that my husband´s status is basically as an illegal in the US?

as long as you arrived under legal conditions to the US, Canadian immigration seems to be willing to consider the application. you still will have a wait of about 18 months.

CIC clearly requires you to submit your current visa´s in another country. If you don´t have status in a 3rd country they will not accept your application. You will then need to file from your husbands home country.

You ought to clarify from a lwyer on that point. On the same note however I don´t understand your accusation of the US govt. If you are a US citizen and lawfully obtained papers for your husband even if they are lost they can be obtained again. Everything has been on computerized system.

CIC will not go on hearsay - you will have to substantiate your argument; which does not seem to hold.

I mean no offence; but I´m only offering what is a practical advise.

Actually, there is nothing in the rules that seem clear about this...I am a US Citizen and therefore applied to Buffalo. My partner has no status in the US. I applied as the principle applicant. My application was received and file was opened, received AOR. I know that if you are NOT able to apply at a specific visa post the instructions state that CIC is to return your whole application, including fees, and not make a record of anything. I explained everything in my application, so they still opened the file. I´ll have to wait about 9 months for IA, but at least I know since I am the principle applicant and a US citizen I am able to apply to Buffalo. Nothing is mentioned about the status of family members. (Believe me, I´ve read and read and read). All I can do is wait to see what they say after the IA! Good luck with your case. I empathize with your situation.

That is one approach.

As a US Citizen you can apply as principal applicant and then later sponsor your husband.

I think you will have to include your spouse in the application when you file or else you will be ineligible to sponsor him later!!

I remember Schedule 1 to ask about the principal and spouse/partner about their visa and criminal status in other countries as well as their own. When you answer "yes," you have to explain why. Please double check.

My application was just returned because my visa in the states expired. They instructed me to apply from my home country. Don´t waste your time trying from the states if you are illegal, they would return your application telling you to submit evidence of your US Visa, and you must prove it is current and that you are NOT out of status. In other words, if you are out of legal status in the USA, don´t apply for a visa for Canada. Hope this helps you save LOTS of time. I just went through it. Good luck.
