| Subject: Visa info--Please help |

Hey
I am in US on H1B visa and I got an extension in 2003 for another 3 years.However the rules changed in the meantime and I could not get H1B visa stamped in USA.I do have a valid I 94 on my passport from my last visit to India in 02 which was till Jan 06 and new approved H1 thought it is not stamped on my passport...\
Now the question is if I have to land in canada..Do I need to get the H1B visa stamped first and then go to canada which means I first go to India and then to Canada or since I have a valid I 94 I can enter Canada ,get my PR and come back to r USA again and plan my moveing etc.Please let me know if anyone has faced similar situation....

You can land in Canada and come back with the I94 within 30 days.
Also you can apply for the visa in Canada since you´re not a landed immigrant there, however if you are refused the visa for any reason you can not use your I94 to return, so the best would be to come back within 30 days with the same I94.
