Subject: PR Stay requirements
  My papers state that you need to live in Canada for atleast 2 years in a span of 5 years to maintain your Permanent Residency status. I suppose, if I fail to do so, I end up loosing my residency.

Now, if you know someone or have been through a situation where you ended up living outside for more that 3 years in the span of 5 years, thus failing to fulfil the PR requirements, please let me know what were the ramifications. Do they or will they strcilty enforce the rule, or will they be lenient and allow you to be in Canada, say if you are back after 3.5 years or 4 years..thus staying away for extra 6 months to a year.


PS. Please refrain from commenting, how one should only apply if one wants to stay etc...

You will probably and most likely lose your PR....you broke the rules by being out of the country for more than 3 years of 5 years. The rules say you must be in Canada for 2 years of 5 years and if you are not, you lose.

Dear Anonymous,

I haven´t violated the requirements of PR yet, but wanted to know what are the consequences in case i have no other choice but to do it.

Have you or anybody you know had any kind of experience with this, or are you just giving me your interpretation of the rule. In any case i appreciate your response, but would prefer to also receive more replies from someone who has direct experience of this kind of situation.

it is a fairly common occurance in my community. (we have a lot of Asians who leave their wife and children in Canada while they remain overseas working) People violate the conditions of their PR and CIC simply revokes the PR. It is not something CIC takes lighty.

I am not exactly sure how they track it... but they do and they certainly enforce the rules.

PR card has a little memory chip to restore your summary time of staying in Canada; it´s computerized in the airport once you enter into Canada. Just like credit card and debit card.

the time you spent in Canada before PR also counts.
only half.see if you can show CIC

For example, I am not PR right now, however I have already stayed in Canada more than 3 years, so once I become PR, I have other extra 1 year and half time that I have already lived in Canada.

you are right about the chip. I had forgotten all about it. You can´t really argue with a computer chip and a scanner.

Well I had no intention of lying to CIC about my stay period. But this info is very helpful.

Basically, what I learnt from this thread is, CIC will revoke the PR once they are informed or learn (through the chip) that I couldn´t fulfil their stay requirements.

Anybody´s got any experience of sending an appeal or request to reconsider or restore the status? Is there any chance, or as far as they are concerned, once they revoke you are done. If you want it again, you have to go throuh all nine yards all over again..In other words, is there any other alternative, or you will be back to square one?

I am not quite sure, since I am not PR, I don??t have PR card. However, remember the time around 2003, CIC asked all PR to register PR card. On the papers commercial, I remember they mention something like?? Personal information from the IMM 1000 Record of Landing or the Confirmation of Permanent Residence document is encoded and accessible only to authorized officials??.

I figure out the only way CIC could find out is put a computerized chip like driver license and credit card.

That??s what I guess, CIC might have different ways to track you down how many years did you spend in Canada.

You know what? Personally, it??s your choice to stay in Canada or not. However, tax payer spent so much money to CIC and Canada invites immigrants who want to beat the system, just immigrant for convenience purpose, not really wanna stay in Canada.
I feel sad. Because you can check out federal budget, how much money were spent in ESL classes, multiculturalism. At the end, landed immigrants wouldn??t want to stay in Canada, what a waste.

i guess, hopefully, i will try and not violate the regulations, and be able to maintain the residency...for its quite clear from the link provided, that unless one wnats to risk it, one should maintian the residency requirements otherwise there is serious chance one might loose it..i guesss very soon, i will move to canada for good.

ive herd that some ppl got their citizenship without spending even a r in canada, that was probably in 1999-2000
all they did was get a new passport each time they entered canada, that way the officer didnt know the last time they left or entered canada
i dont know wht else they did, i wouldnt want to take that risk anyway.
