Subject: Cancellation of my application
I would like to cancel my Canada PR application which is approved in Feb 2003 but I did not land in Canada.Meanwhile I reeceived my US Green card and I decided to stay back. What is the process of cancelling the Canad application and get refund of RPRF. Please advice.

After a PR visa is issued the applicant has to land in Canada before the visa expires.

Your visa has definately expired so your PR has been cancelled and the case has already been closed.

I think you are out of luck on the refund. Canada did their part - so not sure why a refund would be issued.

No, Canada didn´t do their part yet since the applicant didn´t land in canada. I think CIC says that that fee is a compensation for all the benefits that the applicant will get in Canada.

my understanding is that a refund is only issued when an applicant is unsuccessful in their application. in this case... our friend was offered PR (aka success) and he declined the offer.

Right of Permanent Residence Fees are Refundable:
The Right of Permanent Residence Fee is paid for the right to obtain permanent resident status in Canada. The fee is partial compensation for the many benefits and privileges that permanent resident status confers. This fee will be refunded for unsuccessful immigrant applications or for those who withdraw or otherwise abandon immigration to Canada before the visa has been used. Right of Permanent Residence Fee refunds are issued by the office that concluded your application.

Technically as you did not use your visa you should get a refund of your RPRF. Best thing would be to contact Buffalo and explain your situation and ask for a refund.

for our posters sake I hope he gets his refund. I would like a follow up report on the subject. I still remain of the opinion that he does not qualify for the refund but that is my own personal thought on the subject. let´s see what happens.
