Subject: PP request received but........
  Hello friends,

Today I am very happy because yesterday my consultant rang me that he has received the Passport request for me and my family after 2nd medical. But he is demanding last installment of his fees before issuing the visa. As per our agreement I have to pay his last installment after issuing the visa. Should I have to submit his last installment before visa. My e-status is still showing "In Process".Is it correct ?????

Any one can answer me how long it take for visa. How I can judge that my consultant is saying right words for PP request. Can I check it from CHC, New Delhi. I am a skilled worker category. My time line is

App. sub. Feb 2001
file No. April 2001
Interview waived : Oct.2004
1st Medical : Dec.2004
2nd Medical Jan.2005
PP Request : 15th april.2005

Can Any one tell us the format of PP request. Is there any time limit , in which I have to submit my passport ? Should I have to submit my passport personaly by changing the address ? But I think it´s not fair at this stage ? Please guide me , I will be very much oblidge for all of you.

you have entered an agreement with your consultant. Your passport request means that the immigration process is 99% complete. As a consultant...the only leverage he has to insure that you complete the terms of your agreement is to hold your passport until he receives payment. I think you have two options. 1) have the passport sent to the consultants office with the final landing papers. when they are ready, you can go and pay your final installment and claim your documents. 2) pay the consultant and have the passport sent directly to you.

Thanks sharon again. But How I can check that the PP request paper which he is showing to me that one is genuine and correct ? Could it can be false or fake for receiving the last installment ? after all I have to submit my original passports.... which is also a risk factor...

hopefully you retained a reputable consultant! I cannot imagine someone saying they have your PP request just to get money from you. (but then I might be naive) Do not rely on e-client. they are so slow that your status may have changed and it could be weeks before you see it online. there is a time limit to submit your passport (not exactly sure how long because we are still waiting ourselves).

You are at a trust crossroads. you trusting the consultant that he in fact has your PP request and the consultant trusting you fo final payment. Go back and read your contract agreement carefully to see exactly when payment is due. My guess is it is a the point of PP request not visa receipt.

No, It´s on the Upon receiving the Visa. Thanks again for quick response. I think I have to pay half installment of the last one. And another half have to be paid upon receiving the visa as per the agreement. Right ?

I guess the technical question is ´what constitutes receiving the visa´. Successful application or the physical documents in hand. If the consultant does not have any control over where the passport will be sent, my guess is (from a business perspective) that your application is at a point where you can no longer be declined. You have what you hired him to do. A Permanent Residence approval. The consultant has fulfilled his duties to you.

Not sure why you think he still has more work to do to earn his final payment.

If you are unhappy with your consultant you can revoke the "representation clause", i.e. simple as just sending a fax by principal applicant to the embassy where you case is filed letting them know that you no longer require the agent and all future correspondence, including requests for passports be sent to you directly.

Remember it is your case the embassy has approved and not your agents so you have a right to call back the correspondence to you anytime you like. If the passport request has been sent to agent the embassy will send you a copy to your address directly; however it may take some time (like 2-3 months).

On the other note it is only "ethical" to pay up the contractual obligation to the agent. The agent may hold you to court to pay up if you indeed signed the document to pay. Now what you can do is prove a breach of contract by having you fax a request to send money ?before? the visa has been issued. Then later you can defend your right and statement you make here.

ok... the consultant called to say he has notice for the PP to be sent. Passport is sent in via the consultant. as our poster has said, he will not give him the visa until he is paid. it is an exchange. I am not sure why this is so tough. all of a sudden our poster thinks he is getting scammed. He does not need to turn over any money until the consultant has his passport on his desk with all the appropriate documents. I read our first post again - the consultant is reminding the applicant that he will not release the passport without payment. Reasonable instructions.

now we want to start telling CIC to resend PP request and change addresses...adding months to the process. why? so our applicant can avoid payment?

Sharon, I appriciate your suggestion. Now, There is no delima in our mind. After all my consultant has been doing his job since year 2000 and actually he is also tired now with my case time period. But only a single question in our mind is this after getting the Visa he can demand more money from me. And he will not take interest in my case after getting his last payment which is only Rs.10000.00. So I will discuss with him Pls take 50% at the time of submission of passport and rest 50% at the time of receiving all the landing papers and Visa. Right ?

how did you find this consultant... was he recommended to you? You made a decision to use them based on what factors? obviously, you gave him money up front and he did what you contracted him to do - prepared and submitted your application. In Canada, immigration consultants must be registered which should hopefully mean they are honest about their services. Not sure about your situation. has your consultant given you any poor service or have they given you any reason to think they are not trustworthy?

perhaps, ask to see the letter? I do not know what it will take to satisfy you. I also do not know what is causing you to be this mistrusting at the very end of your process.

if the visa papers and passport are sent directly from you, I would guess the consultant would be nervous about waiting for the final 50%. you would likely have to have the documents sent to his office. If he deceived you in any way, his future business would be ruined. thing like that get around.
