Subject: DUI
  Hi, i got a DUI two years back, fro which i was given a fine and probation. everything has been completed by me more than a year ago. FBI report is clean too. my interview was waived earlier. i have a letter from the consulate in buffalo stating that they need to see court records and a statement saying what happened. i already told tehm about teh dui, being honest. I am scared that this will affect my immigration process. can anyone advise me please? thanks a lot

I was in the same situation as you. If you had an actual conviction, that would show on your record. If the court didn´t convict you but just gave you fines, probation and so on than you will be fine. Canada takes DUI very seriously. They told me that if I had been convicted, then I would be criminally inadmissible to Canada. I wasn´t, I paid fines and stuff and I did have to give them a letter explaining the situation and also local police records (FBI as well).
If your case is the same, as long as you provide them with these, they will be O.K.

I hate to say so, if Canada considers DUI is serious crime, how comes so many people drink and drive. Even British Columbia Premium Golden Campel drank and drove and get caught!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!sigh!!!!

Canadians have deported PR people in recent past for getting DUI in Canada. They had to invoke a special clause in their legislation to allow George Bush visit (he also has a DUI on his record). I guess if you are a native born citizen, you get the privilege to get caught drunk as an ass! I drowned in booze in the US so many times, but never ever drove after drinking. I would rather not drink if I know I need to drive afterwards. They need the same level crack-down on the druggies too.

you know what? my town everybody smoke weed, they grow indoors too. When we have party, all my friends force me to smoke weed, oh, boy, can´t understand why they love weed so much.

Well, I was like 0.03 points above the alcohol level, which is 0.08. So it was not a total drunk driving thing. I am not sure if there was a conviction, my lawyer pleaded "no contest". No arrest record shows up on my FBI background checks. This is ironically funny, because I never even have got a speeding ticket before!

lila, when you say you were not convicted, what does that mean? surely u have to have some sort of conviction to get fined and probated

Here is the information from CIC about inadmissibility:

Can foreign nationals who have been convicted of a crime or who have committed a criminal offence ever be allowed into Canada?

Such people may be allowed to enter Canada in the following situations.

* They are able to satisfy an immigration officer that they meet the legal requirement to be deemed rehabilitated; or
* They have applied for rehabilitation and their application has been approved; or
* They have obtained a temporary resident permit; or
* They have obtained a pardon from the National Parole Board of Canada if the criminal offence was committed in Canada, or they have obtained a foreign pardon recognized in Canada.

Any activity that is considered a criminal offence in Canada, such as driving while under the influence of a substance such as alcohol, may prevent you from entering into Canada, even if the activity was not considered criminal in the country where it was committed.

Andrew, not necessarily.
My lawyer bargained with the prosecutor and as a result, since it was a first time as well, I got what they call a delayed sentencing, basically if you complete your probation sucessfully, they will not convict you. Check the records at the courthouse where you went to, ask one of the clerks, you are entitled to see them and get a copy. Since your FBI report doesn´t show anything, you propably got the same thing as me. I was told that if you had anything at all on your record, even minor the FBI report would show it. As I said, just get the copies, write a letter of your own and send it to the immigration, it will be fine and they will be happy with it.
