  Lila, thanks for the info bud, I am feeling better now. My DUI lawyer says that mine was a conviction, but its regarded as an infraction and a driving violation or misdemeanour. He says its not going to affect anything, but we will be sending in the court papers and an explaination. i do remember him getting the lesser charge of reckless driving out. But as I said, the FBI report shows No Arrest Record. Thanks again

was this lawyer in the US or Canada? I ask because the it really doesn´t matter how the infraction is viewed under US law. Canada looks at the facts to determine if the act would have violated a Canadian law, then looks at the penalty that have been applied in Canada. Canada is much, much tougher on DUIs than most places in the US. DUI convictions in Canada are considered criminal offenses.

I personally know two US citizens just trying to spend a few days in Ontario fishing who have been denied entry at the border because of single DUI convictions each. First time offenses for both.

I would check the regulations on the CIC website, or talk with a Canadian lawyer experienced in these things.

Andrew, there is a huge difference between an infraction and a misdiminour. If you were actually convicted, I don´t understand how it doesn´t show up on your record. Also, in Canada, DUI convictions are considered criminal convictions, no matter what they are in U.S.
Maybe your is expunged (deleted of the record) make sure to ask your lawyer about the specifics of the case.

Hi guys,

I posted a similar topic a while ago, but I didn´t get any valuable answers...I´m sponsoring my husband who´s had a DUI 5 years ago, which included an accident, and since he was 19 and it was his first time, they offered him a ´deffered prosecution´, and he wasn´t convicted. He has behaved ever since, but as I said, the accident was involved. Immigration sent a letter that they expect to finalize the application without an interview, and they asked him to sent court disposition of the case, police report, and financial obligations. We did that a week ago, and now we´re waiting. What do you think is gonna happen? We didn´t get a lawyer.

5 years ago I would say he would be rehabilitaed i.e he can apply for teh DUI issue to go away.

If he got deferred prosecution, than after the completition og probation period (6 months to 1 year is the norm but it could have been up to 2 years) his conviction would not be recorded. You should be fine. Just make sure that you send them original court documents as in my case they would only acept originals.
