Subject: can I apply for working visa within Canada, when
  can I apply for working visa within Canada, when my extention for visitors visa was refused? I have only one month left to apply for restoration from the 90 Days timelimit

If I can"t do it
what"s happen at the border ,when I will leave Canada two months later ? Will they put in my passport " unwanted " because I overstayed ?

how can you apply for a work permit when your extention even refused? youcan not. Rest no body will see your passport while leaving Canada but if you will go to USA without Visa they will send you back to Canada and Canada will de-port you. I don´t know exactly what is your status is now and from where you are?

If u have been refused an extension u r ineligible for "restoration of status". What did ur refusal letter say?

You should quitely leave asap to ur home country, nobody will mark ur passport and then apply for work permit from anywhere outside Canada.

I am not sure whether Immigration people have access to info on departing passenger. If they do then they might also be maitaining a record of defaulters by cross-checking and red flagging them for future. But I think its highly improbable for them to do so....rest is anybody´s guess.

You can`t apply from within Canada for a work permit under these circunstances.

When you leave Canada , the airline will confirm your departure to CIC , if you over stayed in Canada and then you leave , next time you try to re-enter Canada as a visitor it will show that at the screen monitor of the Immigration Officer at the port of entry and you may be refuse of entry.

If CIC gave you a volunteer departure order , you must leave Canada before this order expires , apply for a work permit from abroad and then go back to Canada.

Hello Robinhood

I was in Canada once under work permit and I got an extention once.

The second time that I applied for an extention , CIC was under a strike or something like that so they called me in for an interview. They took so long for the appoiment!
By the time of the interview my visa was already expired but the agents from the CIC call centre said that I shall remind in Canada until a final decision by the CIC officer was made.

At the interview the officer figure that after 2 years working in Canada I should go back home , BUT as my status was expired (not my fault)he gave me a volunteer departure order to leave Canada within 30 days.

The officer told me that I have to give the volunteer departure order to the U.S Officer who will confirm my departure from Canada , sending a copy of it to the airline as well as CIC.

I had to declare U.S customs and Immigration at the airport IN CANADA and I had to leave a copy at the airline as well as the US officer.

I don`t know if is any different though with him , but for sure CIC can trace if you have or still in Canada.

Now I am applying for my PR and so no problem.

Hi Andy,

Thanks for sharing the info. But even after reading your case I am not convinced that the Immigration authorities are able to match the data of expired permits to the departing passenger lists. It is too much in terms of volume and complexity of procedure.

Look even in your case the CIC asked you to submit the docs to the various authorities. If they had a system in place to verify, they wouldn?t have asked you to submit the docs and get them acknowledged. What I am also making out from your case is that you are not a resident of US but wanted to go there on some permit which required your legal status in Canada at that particular time and hence the need to prove to the US officials about your innocence.
