Subject: Parenal Sponsorship
  My parents are coming to visit me in Canada. They are 63 and 61 years of age and really don?t have anybody to look after them in their native land. I am a naturalized Canadian Citizen living in Canada, with healthy income to suffice the immigration regulations on income for
sponsorship. On sposoring my parents, I have following questions:


1. I want sponsor them as soon as they land in Canada - as the processing time for parental sponsorship is horrible. Is this possible? They have only six months of visa. I guess, I could extend another six months once they get here.


2. Since I will be filing the sponsorship application from within Canada, will it make any difference if they leave Canada say after 6-7 months? Do they have to remain in Canada until their process is complete?


3. With the recent changes of parents sponsorship, after what stage of the sponsorship application can they apply and obtain visa for 5 years? Do they have to remain in Canada until that period?


I would be grateful if someone could answer my questions or let me know if anyone has gone through the similar experience.

you are telling CIC 2 different messages... you say they are coming for a visit and will return home and then you say you want them to stay with you in Canada. That makes CIC very nervous. Right now there is a lot of confusion about how sponsorship and visitors visas are being handled - hopefully there will be some clarification in the next few weeks.

Thanks sharon. My parents are already in Canada on a visitor´s visa. Since sponsorship application takes way too long (22 months here in Missisauga) and around 3-4 years in the visa office that they would be applying if they were in their home country, I am thinking of applying (sponsoring) their PR from "within" canada. Is this possible? In other words, is it possible to apply the parental sponsorship without getting the package shipped to their home country? I am ok with 22 months in missisauga or vegreville but not another 5 years. Also, where would I get the latest information (5 years of visa when sponsorship aplication is in process)? Would it be CIC website or somewhere?

Just a comment-what you are wanting to do is exactly the reason it is so hard for parents to come on a visitors visa in the first place.

Kudos to you Ednap for being a worthy son. In this materialistic mean world there is a very small percentage of people like you who do not forget their old parents and are fulfilling the due responsibility of taking their care.

Sharon I do not see anything wrong in Ednap´s case. If your intentions are to bring your parents here, why wait for 5 years? The delay of 5 years in processing has nothing to do with fairness.

I really fail to understand CIC´s logic in denying visitor visa to the parents of Canadians/PRs (although they r waking up now and willing to give 5 years visa..v.good thinking!). Eventually they would be granted PRship after 5 years or so. What is the harm in letting them come on visitor visa before that? Infact recalling from a close case I know, the visitor visa actually would help the parents in judging whether they want to live in Canada or not.

An acquaintance of mine had his parents immigrated to Canada, but eventually they returned back because they didn´t like the life over here and preferred to spend rest of their lives in a society where they had spent most of their lives. (Ednap I think you should also take cue from it and take your parents opinion.)

Anyways, if u r going for parental sponsorship enquire from CIC whether they can apply from within (as there might be some minimum stay time condition). If yes just go ahead as it´ll be shorter wait; meanwhile you can apply for another extension..no big deal if you r showing your financial support and a strong reason for stay.

Thanks Robinhood for your kind words. I believe my parents have given me everything they could and made me what I am today. Currently, there is nobody with them in their home country. All my siblings have settled in the US, except me who is in Canada. I consider it is my duty, love and display of gratitude that I invite them to live with me, now that they are getting old. I am not sure if they would like to live in Canada, which I chose to live and I am very happy with my decision. And in fact, my parents are not coming here to get a "better" life. They have worked all their lives, both reaching the success of their careers. In fact, I think it will be really sad for them to spend time in Canada as there are not lot many from our community and social background. Nonetheless, I want to be around them. And slowly, age has taken its toll on them and I have realized that they want to be with thier children.

One of the primary reasons for getting a PR for them is the free access of getting in/out of the country. I know of multiple cases when parents have been denied visitor´s visa. A friend of ours invited her parents to be with her during her maternity leave; unfortunately her parents were denied visa. I don´t want this happening to myself. And honestly, this 5-year visitor´s visa program still looks shaky to me. It could be just an election-spin. Who knows?

In any case, do you think lawyers are good idea? Better than doing it yourself. I came here as a student and so far, I have done my immigration and sponsored my wife (from US) by myself. Let me know what you think.

I doubt that there is a way to jump to the front of the line using visitors visas. The sponsorship wait is long for everyone. If your idea was adopted by every child waiting in line to bring their parents to Canada, we would have chaos.

I would recommend your parents also try and live with your siblings in the US. If the goal is for them not to be alone, then at least you have accomplished that much.

By the way... 61 and 63 is not old!!!!!

unfortunately I believe it´s not possible to apply within canada in parental case, only spouses and children. They will have to go back there and apply from there. Sorry for bad news, but that´s what i heard so far.

Once your parents are in Canada, you can sponsor them on the basis of "Humanitarian & Compassionate Case" as they are old and have no one to take care of them back home.

Humanitarion case, if approved, will take a total of 2.5 years.

Thanks Beavis for your suggestion. Yes, the plan is my parents to spend time with my brother and sister in the US and with me in Canada. However, the US already rejected thier visitor´s visa on the grounds that they will not return to their home country. Canada did not. But I know of cases, where Canada has also denied vistor´s visa to the parents of Canadian citizens and permanent residents. Nonetheless, they will be applying for the US visa again but the hopes are slim. Also, to apply for the visitor´s visa to the US, they would have to return to their home country.

Regarding the age, Ms. Sharon, 61 and 63 might not be old here in Canada, but the place they come from, where the avg. life expentency is less than 65, they are very old. And regarding the chaos, that´s a whole different story!

if your parents are old, and most likely not very well...what are your plans should they need a doctor or hospital care? have you taken out private insurance?

Hey Ednap,

It was so nice to read about your thoughts and beliefs in regards to taking care of your parents; I think exactly the same way as you do and infact it was like reading my own thoughts.

I am also in the process for my PR and have been in Canada for almost 3 years now. I like Canada but at the same time love India too; after all I was born there and spent my golden years. Although I am going through the process of getting PR but am a bit confused about this whole thing. What bothers me is that I´ll have to live away from my parents who are almost of the same age as yours. I know in future I would want to be near them but I don´t think they´ll be happy living in Canada. After all they have their whole social circle there and the are used to the way of life there. It would be a torture to ask them to live here just because I want to live here. I think that will be very selfish of me.

Making the long story short- I think the solution would be to get the dual citizenship of India & Canada so that I can move about freely between the two countries and manage my life in the best possible way.

Coming back to your case I feel there is nothing wrong in taking the advice of a legal consultant if you feel the need for it. Just enquire about the possibilities with the local CIC office in person and since you´ve already successfully sponsored your wife it would not be too difficult to put the papers etc. Lastly I think your parents should apply to US from Canada itself, there is no necessity for them to return back and then apply from home country. Americans are jokers and understand things when put the other way.

Hey, yes Sharon has made a good point of getting your parents medically insured if you haven´t already done so. So all the v.best for everything and if possible let us know how it goes.
