I saw the letter of Rehman and I have few questions ,if someone can help me about these ?
I talked to a lawyer and he told me that I can sponsor my younger bro/sister if he/she is below 21 .Is it? But according to the reply letters to Rehman I can not do that directly . I have to sponsor my parents first . Is it true ?
Lawyer also told me that if I sponsor my brother who is less than 21 years old , then it does not matter if he is a regular student or not . and if the whole procedure take 3/4 years then my brother will be 24 then . that time it will not change anything if he is not a regular student then because he was below 21 when we applied . Did the lawyer lie to us ?

To immigrate to Canada under the Family Class, an individual must be sponsored by a close relative living in Canada as a permanent resident or a Canadian citizen. This is known as Family Class Sponsorship.

A Canadian citizen or a permanent resident can sponsor relatives or family members residing abroad if those relatives are:

spouses, common-law or conjugal partners 16 years of age or older;
parents and grandparents;
dependent children, including adopted children;
children under 18 years of age whom you intend to adopt;
brothers, sisters, nephews, nieces or grandchildren who are orphans; under the age of 18 and not married or in a common-law relationship; or
they may also sponsor one relative of any age if they do not have an aunt, uncle or family member from the list above who they could sponsor or who is already a Canadian citizen, Indian or permanent resident.
A son or daughter is considered dependent with regard to immigration when the child:

is under the age of 22 and does not have a spouse or common-law partner;
is a full time student and is substantially dependent on a parent for financial support since before the age of 22, or since becoming a spouse or common-law partner (if this happened before age 22); or
is financially dependent on a parent since before the age of 22 because of a disability.
In some cases, a Canadian citizen or a permanent resident may sponsor a spouse or common-law partner who is already living with them in Canada.

To sponsor a close relative who wish to immigrate to Canada an individual should be:

18 years of age or older,
A Canadian citizen, or a permanent resident living in Canada, and
Has not defaulted on a previous sponsorship agreement;
Is not facing criminal charges or awaiting the outcome of an immigration inquiry (if a permanent resident).
Meets the financial criteria set by immigration authorities (except when sponsoring a spouse).
The last requirement is to demonstrate that the sponsor will be able to ensure their relatives´ basic requirements of everyday living.

To sponsor a relative or family member a Canadian citizen or permanent resident must sign a legal contract with the Minister of Citizenship and Immigration that is called Undertaking. Sponsor must also sign a Sponsorship Agreement with their relative that outlines their mutual commitments to each other.

Family Class applicants are not assessed by the point system. But they have still to prove to the visa officer that they meet Canada´s health and security standards. Family Class Members and their dependents will need to undergo a medical examination and provide a police certificate for every country they have lived in more than six months. They may be called to interview with a visa officer.

When a sponsored relative and their dependents arrive in Canada, they become permanent residents, with all the rights and responsibilities that go with the status.

The lawyer is LIAR, I started my family sponsorship in July 2002 at that time my brother was 21 and full time student!
In October 2002 - Sponsorship approval letter from Mississauga received.

to make the long story short, my family had an interview back in October 2004 and my brother was asked to bring all school documents. he was of course done with his bachelor degree and was studying in private college to get his Microsoft certified engineer certificates (MCSE) but was denied and they told him at the time of the Interview he was over 22 with no full time study (they didn´t consider the MCSE study @ the private college) so they said if the sponsor didn´t drop you from the application, the whole application will be cancelled!
I went to my M.P. to complain and found out that there are a lot of cases like mine, and nothing can be done because the CIC blame it on the back log!
I know it is not fare, because they should consider the age requirement when you started the application, if my application was processed within 2 years then my brother will be here in Canada, but because the processing time is getting closer to 3 years so he lost the chance to be here. Of course he can apply as skilled worker after he gets some experience but that will take at least another 5 years.
