Subject: Do I still have PR status
  I was give Pr status at the age of 8. After growing up in Canada and attending college and working for almost 18 years. I was offered a full time position in another country. My employment in Canada only provided 9 months full time employment. I am in the golf industry. Now I didnt know that If I left for more than 6 months I had to give up my PR status. I left In December 1996. The contract of employment was for 3 years. Since then I have renewed that contract twice as I was told that I couldnt go home to Canada. Now, my wife is Canadian and OUR daughter is Canadian. However I want to become a canadaian citizen and not wait the 3 years required. Since I was out of Canada with a citizen do I have any lope holes that I can use? I still have a canadian drivers licence a visa account with my bank. I was also stopped at the buffalo border while going home to see my family who is mostly Canadian citizens but they told me that I couldnt enter unless I gave up my PR status. I still have the PR forum (original). Then the coustoms officer told me that I could go before a court to plead my case to keep it. We are planning on moving back to Canada in the next year or so. Any and all advice is welcome as well as the name opf a good (cheap) lawyer.

I believe you must reside in Canada 2 out of every 5 years to maintain your PR status. If you have not taken out citizenship, you are still covered under these rules. I would check with an immigration consultant or lawyer to see what your options might be.

What´s wrong with where you are now living? I would say seek residency where you got your job and your heart... If you are retiring to Canada, you might as well proceed the slow route of becoming a citizen over 3 years or whatever. Good luck. I am guessing you are in the mighty powerful economy of the US.

IT SURE WOULD BE NICE, HOWEVER I AM NOT IN THE STATES. CONTRACTS CAN ONLY BE RE-ISSUED SO OFTEN.

hi malcolm,

u need not surrender ur PR status. the fact that u were residing out of canada with ur wife who is a canadian citizen, establishes proof that ur canadian PR is still valid. the law states that u can still maintain ur PR status inspite of being out of canada, if u are accompanying a canadian citizen, who is ur spouse. the time u spent out of canada with ur spouse (only after she became a canadian citizen) will count as ur residency period in canada in order to maintain ur PR status. do engage a lawyer in this and appeal for the case. do not let go ur PR status.

MY WIFE WAS BORN IN CANADA WE WERE MARRIED IN 1998 2 YEARS AFTER I LEFT CANADA. IT IS I THAT IS THE PRIMARY WORKER IN THE FAMILY. SHE IS STAYING AT HOME WITH OUR DAUGHTER WHO IS ALSO A CANADIAN CITIZEN. DO YOU THINK THIS WILL MATTER. DO YOU ALSO THINK THAT I CAN FIND OUT ALL OF THIS INFO WHEN I MOVE BACK OR DO YOU SUGGEST DOING IT FROM WHERE I AM NOW?
