Subject: Spousal Spons. Timeline with Appeal - Islamabad
  My wife finally received her Passport back with the visa stamped!!
Just to let you guys know, this was the hardest time of my life as I have been away from my wife for 3 years!!!
Timeline:

Aug 2002 - Married in Karachi Pakistan

Sept 2002 - Left my wife in pakistan, and came back to Canada alone :(

Winter/Spring 2003 - Wife readies documentation, passport, medicals etc. This took about 2 months due to how hard it is to get this kind of thing done where my wife lives.

End of June 2003 - Applied for Sponsorship

End of Aug 2003 - Received rejection letter from CIC Mississauga, application still forwarded to CHC Islamabad. They rejected it on a small technicality, which I believed was a misinterpretation of the immmigration policy.

Middle of December 2003 - Application rejected from CHC Islambad as well.

End of December 2003 - Filed Appeal with Immigration Appeal Division (IAD) in Toronto, hired lawyer to help me

June 2004 - Received documents for IAD hearing

July 29, 2004 - Lawyer represented me at hearing. Each side was told to prepare a factum of the case and submit it asap.

September 2004 - IAD Member (basically the judge) allows appeal since the IAD side didn´t submit any documentation asked for, and the member agreed with my lawyer´s arguments that the immigration officer misinterpreted the family class law which caused the rejection.

Dec 2004 - My wife applies for a new Passport in anticipation of passport request as her old passport expired.

Middle of February 2005 - My wife finally received some response from CHC Islamabad. She was told to fill out new Permanent Resident Application forms, and do her medical again as the previous ones expired. However, CHC Islamabad did not include the forms and did not tell us which forms were required. We called them, and they sent it again, but this time they sent the wrong forms, they sent Skilled Worker Application forms. Regardless, we sorted through this mess, sent whatm forms were required.

Beginning of March 2005 - My wife does her medical.

Beginning of April 2005 - CHC Islamabad requests a new Police Certificate (something they apparently forgot to request earlier).

April 29, 2005 - My wife receives her passport request. She submitted it the next day.

May 20, 2005 - My wife receives passport back with visa stamped along with all documentation returned (they kept it for 2 years)


I can now say that my wife is finally coming to Canada!!! I have only visited her once for 3 weeks last August, besides that visit, we were separated from each other for the entire time, waiting anxiously on the day we would be reunited.

Right now, I am waiting again though, as we applied for my grandmother´s Temporary Resident Visa, which has already been rejected once (after additional documentation was requested) so that my grandmother can accompany my wife here. This wasted about a month (time mostly wasted in waiting times on Temporary Visas). We applied once more last week, and are now waiting for her visa, but if it is rejected once more, my wife will have to come alone.

All in all, I expect my wife to be reunited with me by the end of June 2005!!!

For all those in similar situations, believe me I know exactly the hardships you are going through. The only advice I can give is patience. I know exactly how it feels to wait. I have constantly contacted my MP´s office for help, as well as lawyers, e-mails, phone calls and faxes to CHC Islamabad, etc, but it did not help. Patience pays off in the long run, as those in similar situations know that your love grows stronger for your spouse when you are forced to live apart as you know how hard it is to live without them.


I have waited 3 years to be reunited with my wife, so believe me when I say the Canadian Government doesn´t really care how long you are separated. They´d rather reject it on tiny technicalities, until you prove to them they were originally wrong to do so, and still you suffer.

i sponser my husband in feb 2008, my husband had an interview march 2009. file resudes july 2009...
appeal filed july...i didn´t get the CAIPs yet..the reason for refusal is :marriage is not genuine.

i file the appeal by myself..

I received e mail from islamabad embassy that my husband case been refused and fee will be refunded. please help me i got marry in 1997 and got divorce in 2006 and 2009 i remarred candaian embassy requirement to complete council divorce i send them which they said divorce was effected in 12 2009 but i got marry in may 2009 they said i was not eligible for marry but i send them proof of my court letter which divorce was held and due to clerickle mistake nikkah nama was writed virgin istead of divorce which make correction please help me which option i have right now
