  Dear Saleh/Sharon:

I am Indian Citizen shortly moving to Dubai on work permit. Initially, I intended to apply from New Delhi. But the Delhi will take much longer time for process. So, I would like to submit my application at Canadian London Consulate immediately once I arrive in Dubai. I have all supporting documents for my application collected within India.

I have one biggest doubt. I have taken settlement funds statement from Indian Bank. Is it a valid document or should I submit bank statement from Dubai Bank? I couldn´t transfer these funds for personal reasons to Dubai.

Saleh, Kindly clarify.

Welcome to Middle East. I reckon you can apply once you come to Dubai, it will take sometime for you to fill the forms etc (that´s if you have not yet done). Besides you have to show your Residence Permit in Dubai to apply that may take couple of months. I suggest give sometime to settle down and apply may be in 6 months by this time you will have a bank statement etc. Also note it is not necessary to show bank statement with your initial application, can be done later when they ask for it.

From what I understand you may not apply from a country other that your own until you have resided there for at least one year. If you apply before that time has elapsed they will process the application in your home country.

I?m actually not sure if this is the case for all application categories, but this rule definitely applies for family class sponsorships. So please double check before you proceed with this plan.

Example: My wife is a Filipino living with me in Korea. Had we applied for her PR within the first year of living here, it would have been processed in the Philippines. Since we applied after one year of living in Korea had elapsed, we were allowed to choose whether her application would be processed in the Philippines or in Korea.

I disagree with you Mike.

I am quite positive that one can apply as soon as one lands in the jurisdiction of a CIC post given s/he has a minimum visa of 1 year for the country.

In other words one doesn´t have to have completed 1 year of stay in that country but only requires 1 year visa at the time of filing application even if it´s on the next day of landing.

I don´t know of this is not the case for spousal sponsorship.

i agree, I do not think you need to complete the year, but I do think you must prove you are intending to be there for a year. Otherwise, people would be going to countries, renting a house for 2 months so they could us a different country for ´home´ embassy. make sense?

I heard from my consultant that you will need one year residence before you are allowed to apply at the CHC post. I do not know if this changed recently.

I think Mike is right. Correct me if I am mistaken.

I just checked the rules for skilled workers, and they state that you may apply from:

?X the country in which you are residing, provided you have been lawfully admitted to that country for at least one year; or
?X your country of nationality.

It still seems a bit ambiguous as to whether you have to be in the country for a year prior to applying, or if you just have to show proof that you have been admitted for a year.

I know for a fact that Family Class applicants have to satisfy the former, but perhaps skilled workers need only show a one-year visa as proof, I really don??t know. I think it might be worth confirming before proceeding, though.
