Subject: question about legal status before submission |

Thank you for everybody´s help so far, this is a wonderful site for people like me to get information and opinions.
I am about to send out application in USA. My h-1 status will have another two year from now and I am the principal applicant, my wife is in H1-B too, her H1-B is about expire this December, currently she is preparing for extension. I remember that there is a post from this site before, and it said his file kicked back from buffalo because his h-1b expiration is less than one year. Does our case have the same problem?

(in reply to: question about legal status before submission) Typically a H-1B is issued when you have one year of experiece or if you have graduated from a US university.
So if you fall under the first category you should be okey... if you have 1+ yr experiecnce combining other types of jobs too then you should be okey

(in reply to: question about legal status before submission) I think CIC´s concern is if you are staying legally. In your case you are legally staying in the US. Just in case your wife won´t get extention, she can have her visa converted to H4 to have a legal status. I am not aware of the case that you mentioned about the 1 year expiry...although I find it unreasonable. Go ahead...apply...goodluck.
