Subject: Wanting to move back to Canada from the US
  I´m a Canadian citizen (23 years old), and recently moved down to the US on a fiance VISA and married my American husband (also 23 years old). There was a lot of time and paperwork involved, but we haven´t done the final paperwork (naturalization and such). We´ve been waiting for paperwork from the government. Otherwise, I´m here legally, I just can´t work yet, and I don´t have a green card (we´ve been married for 6 months).

We´re thinking of moving back up to Canada, now, and I would go back to University. I´d like to take him along and have him be able to work, but we don´t know what paperwork needs to be filled out and what steps need to be taken. Is this going to be as much of a process as me moving down on the fiance VISA, since we´re married now?

Hi Denise,

Saw your post on the other forum too, but this one doesn´t require signing up ;-)

I, too, came to the States on a Fiancee visa, 4 1/2 years ago. My husband and I are now in the process of going back up to Canada, as there is more opportunity for him to start his own business, and, well, I miss my hometown. ;-) We *just* submitted all the paperwork as me sponsoring him from outside of Canada. I had to show that I will be in Canada when he lands as a permenant resident. I will be going (back!) to college in Victoria this fall, so I submitted my acceptance letter as well as several things showing my ties to Canada, such as bank accounts. Also doesnt hurt to have letters from family members stating you will be returning to Canada. As well you know from dealing with US Immigration, the more evidence you can supply, the better!!!

You could also return to Canada and apply from there, but as I understand it that may take longer, plus he would not be able to work, and if you´re planning on University, that may not work well.

Oops, I should also add that I don´t think (at least from what I´ve done so far) that it will be as much of a hassle as coming down to the States. You will likely need a co-sponsor, though, since you will be a student.

Correct me if I´m wrong, but from what I read on CIC application forms, I see that when sponsoring a spose, you don´t need to show that you are working, and making a lot of money. Well, you need to explain to CIC that you have some funds stashed away, or that your family would help you, but you don´t need to show them that you have income, etc.

Well, you may not need to make *alot* of money, but the sponsorship eval for spouses does ask if you are working, your income, etc. If you´re not, they want to know how you live, as in, do you get support somewhere. It may not make as much of a difference as if you were sponsoring another family member, but it is something they ask about.

Thanks for the replies. :-)

My parents are willing to help, but we´re looking for the best way to get this to happen. We´re now thinking of starting the application process here, since my husband does have a job here, in hopes of saving up money so that when the application is done, we can move to Canada, I can go to school, and he can work in Canada soon after.

How long do you think it´s going to take before you and your husband are in Canada, Ms. Mo? And what about when your husband gets to work?

Well, based on what I´ve read and based on the timeline posted on the CIC website, I´m guestimating about a year...but fingers crossed it could take less!!!

We are lucky enough to be in a situation where we are only a ferry ride away from each other. When I go back to Victoria in August he is staying in the US and working there right up until he gets approved. I will be going to school and working part time until December, and then working full-time. Once he arrives in Canada as a permenant resident, he will be allowed to work. I know if he came over before that time and didnt work, we would not be able to make ends meet. Again, we happen to be lucky enough to be close while we´re waiting, so I will be able to go visit every weekend if I want, or even a day trip.

Again, if you´re planning on submitting the app from the States, be sure to show lots of evidence that you plan on returning to Canada with him...school acceptance, bank accts, etc etc... =)

Hi know it´s not about the matter at hand but i also met some 1 from the states and we want to be together.i tryed everything before the fiance paper work but we r not married yet i live in alberta he lives in north carolina my plan was for us to get married over the net it´s been a year then go ahead with the fiance paper work is this possible plzzz can anyone help.

Kathy, you cannot get married over the internet. You have to do the fiance VISA thing. Pick a country, and either you go there or he goes to Canada. You fill out the fiance paperwork, get married in that country, and stay there unless you decide to go to the other country. Then you´d need to do more paperwork.

I´m still having issues with this, myself.
