  Hi Starchief..I have just red a reply you had posted to another thread...You said you had appealed the refusal of your husbands PR,,and it took 1 year for you from the date you sent in your appeal to the IAD,and then also another 4 months for the Canadian Embassy to complete your husbands application after your appeal was granded...Can i ask you what province you are from in Canada..I am also going threw a appeal,,and i am from Nova Scotia..I was trying to get a idea on how long the appeals take from my area..I have heard each province is different in timeframe for appeals,as some areas have such a backlog.Any information you provide me will be greatly appreciated...Did you go threw a ADR meeting with the IAD?...Or did you go threw a regualr hearing with them??..Sandy

Hi Sandy,

Yes I did make an appeal on the refusal of PR for my husband. I received the decision in November 2003 from the Embassy in Paris (which is who is responisble for our case) that he was refused. I had 30 days to send in my appeal if I wanted to appeal the decision. My appeal was done in Toronto, Ontario. I am currently living in Europe (have been for the past 6 years). The reason my stuff when to Toronto is because my parents live about 1 hour from there. I would be flying in from Europe for the hearing so I picked Toronto as the place for me. After I sent in my appeal, I didn´t hear anything back from the IAD until the New Year (2004) when they sent me a copy of my application plus their notes. This I guess was for me to use in my hearing. In April/May, I got a letter from the IAD stating I had to come to Toronto for a meeting to discuss when my hearing date should be and what I have done for preparing my case. I wrote to my case worker and he waived the meeting since I was not able to fly in for one day to attend a meeting. I am working full time and it was not something I could do. So end of May, I received the letter that my hearing date would be end of November 2004. I represented myself at the hearing as I felt it wasn´t too complicated of a case. The hearing was video taped and a judge was there to decide the fate of the application. The hearing took over an hour and after a brief break, the judge came back with his decision. He granted the appeal. At this point I didn´t understand what the next step was. The lady representing the immigration was nice enough to explain to me that my papers would then need to be sent back to Paris for finalization and would take about a month to complete. By January, I still didn´t hear anything so I contacted my IAD case worker and he gave me a date when the they gave the order to send back the papers and that I should contact Paris. I then contacted papers and my officer who did my case said that she did not receive the papers back yet. So I wrote back to my IAD case officer and he had to make an inquiry about where the papers were. Within two weeks, my immigration officer in Paris sent me a fax that she had received the papers, that the application was reopened and she would send us papers within the next few days of things to update. Everything was sent in, medicals were taken again and the ROLF was sent February 14. I had to wait until Paris heard from the CPC that my payment was recieved. Once that happened, Paris faxed us the instructions about how to get the visa for the passport. I guess this actually was the passport request. My husband then flew to Paris to receive the visa and 5 days after that we flew to Canada and made the landing, which was March 20, 2005. I was lucky enough that for the finalization of the application, all correspondence with Paris was done by fax including the passport request. The only thing I received by normal mail was the papers that I had to update and send back.

I hope this helps you out a bit and gives you an idea of what you can expect from the appeals division. For us, it took a long time, but it was well worth the wait. We are moving to Canada in August and I can not wait to be back home. I wish you all the luck in your appeal. If you have any more questions, go head and ask, I will answer what I can.

Hi there! Congratulations on your appeal. I was wondering I may ask you some questions regarding your ADR with the IADs. Since I really dont want to spend $4000plus for a lawyer to just be there with me as I know I will be doing most of the talking... thx a lot!
