Subject: To "In Canada"
  Hi,

One day ago I asked how long police clearances are valid for, and you replied 6 months from date of issue. You said that this was on the CIC website.

I had looked at the website, and could not find this information. I looked again, and still can not find it. There is no mention of the period of validity in the Immigrants Guide, nor the Region Specific Guide. Nor, is it mentioned in the FAQ.

If they are valid for 6 months, does this mean the Case Processing Centre needs to RECEIVE the police clearance before expiration, or do they need to apporve the case for furthing processing before the date of expiration. Or, does the VISA office in my wife´s home country need to receive the case from the processing centre before the police clearances expire?

Also, if you can, could you tell me where on the CIC website you found the expiration date information... I will keep looking but I have not been able to find anything.

Dave, I haven´t read this on the CIC website, but I think a police clearance is only valid for 6 mths.

Thanks... I just spent another 30 minutes on the CIC looking, and I can´t find it. My MP in Hamilton West told me the same thing a while back, good for six months, but wanted to cross reference this with something.

My problem is, my wife (who I am sponsoring) lived in the US for a while. I have the FBI check, and it is 4 months old. We will probably have everything ready to send to Missasauga in 3 weeks...

What if the police clearance expires while they have my documents? I would really like to know how they treat this? Does it have to be valid when they receive the case, or does it have to remain valid until the VISA office receives the case.

If anyone knows, please let me know,

you can try emailing Mr. Miller, maybe he knows. I think he is an immigration lawyer, he answers a lot of queries in the other forums.

I think PCC is valid for 6 months from the date it was issued. Hence if one mails the PCC within this 6 months time to CIC it should be OK. Is there any instances CIC asked for a second PCC? I dont think so.

In my case I mailed my PCC in September 2004 and by June 2005 I got Passport request from Buffalo. It was more than 6 months.

Timeline: app: jul 2004, aor: aug 2004, ia: mar 2005, med: apr 2005, doc: may 2005, Passport: June 2005

Hey Dave,
The period of validity of the police clearances can be found on the Consulate General Buffalo Website (I did not copy the whole address). But anyway, when you´re on that site go on the left side corner and you will have different options for their services. Click on "Visa and Immigration" and you will get different categories and one of which is "obtaining a police clearance." It will give you specific instructions about obtaining it(you don´t need that because your wife already has it) and one of them states that "all police certificates must have been issued within the last SIX MONTHS. Outdated police certificates will not be accepted.
We submitted our police clearances a month before it expired . So hopefully, the certificate/s will remain valid as the visa office receives it.

Thanks all!

I am going to go ahead and get a second clearance going for my wife with the FBI. It takes us a while since neither of us live in the US. If the first one has expired before we submit, at least the second will be on the way!

The police clearance is fine as long as it is received by CIC before it expires. The fact is that the majority of PR applications take longer than 6 months to process. If the expiration clock were to keep ticking during processing time, it would be impossible for most people to meet the requirements for clearance even if they obtained it one day before sending it in. The only document I?m aware of that can expire during processing is the medical examination form. This is why application processes that are relatively shorter (ex, Spousal Family Class), the medical is done up front and mailed in with the application. For longer processes (ex, Skilled Worker), the medical is sent in at a later date during processing.

I was going to explain how to bring up that info on CIC site but Keith and Jude done it already! Well, submit them before they expire and leave it to the CIC people to decide if they need a new, more recent clearance. Usually they ask for a new clearance if they suspect or feel security clearance was not progressing at a pace that it is expected. There were cases when CIC requested additional clearance from EACH state in the US where the applicant lived longer than 6 months! I hope it won´t go that far in your case. If an applicant has "clean record" apparently busy with academic or work activities, they won´t ask these fellers for any new clearance.... but again, this depends on the reviewing officer and it is not easy to predict if they may need or not.

Well, my wife lived in California for the whole time, so we just went with the FBI finger print test, because all states are required to submit records of arrests and warrents to the FBI (along with finger prints for those arrested)
