Thank you so much for your information you have provided me with...Really i sure do appreciate it so much...
You said you had a case worker there at the IAD,,do you mean that there is one person there,,that is appointed to a certain case??..Like a contact person there at he IAD that is asigned to your case,that if you have any questions,,then you get ahold of that person??..You said you represented yourself at your appeals hearing...I know every case is different,,so the questions they ask you at your hearing would be different then at other persons hearing..But were there any general questions that were asked??..Was the person who was representing CIC,,how were they with you??..Did they ask you many questions??..Did you take any more new proof of your and your husbands relationship..What new evidence did you take along with you??..Thank you so very much for your information..Hey August,the best month to come home in..You know what they say,,there is no place like home,,there is no place like home,,there is no place like home,,ooo ya..don´t forget to click your heels together when you say that..lol..lol....Bye for now....Have a great day there..Sandy

Hi Sandy,

First of all I made my appeal based on criminal inadmissibilty. My husband had a problem in the past with the law (1992) and they used that against him. When I had to contact the IAD about the first meeting to decide when my hearing would be, they had to look up the person who was responsible for my case. I had contact with him by phone, fax and email. I was told of my hearing date by email and then an official announcement paper came in the mail. So I would assume that everyone who has made an appeal has someone assigned to their case.

The judge asked me if I was going to appeal based on criminal or compassionate reasons and I picked compassionate reasons. Then he asked me questions about what happened in 1992. After that the CIC asked me lots of questions. She wondered why we didn´t reply for rehabilitation. She wanted to know how disabled my father was and how much care he needed. She asked about how much money we had and why I didn´t move home to take care of my parents and then wait for my husband to come. Well I had been living in Europe for 4 years at the time of application was sent and had been 6 years by the time of the hearing. In the last two years, I had been working and couldn´t really leave my job.

The papers state that 30 days before the hearing, you have to provide the IAD with a copy of documents that you will be presenting at the hearing. We had copies of letters written from my husband´s past employeeers, a letter from the family doctor in Canada which outlined the health problems of my parents and all the emails my mother sent us with problems she had trying to take care of my father. I feel these documents were very important for me winning my case.

I had done a lot of reading on the CIC´s site about immigration wanting to reunited families and I based my documents accordingly. In the end when the judge read his decision, he mentioned that it was a important to reunited families and that because the problem my husband had occurred in 1992, that would be overlooked. Therefore my appeal would be allowed.

I am not sure why your case was refused but make sure you bring whatever documents possible to support your case. I hope the information I gave you helps you. Best of Luck!
