| Subject: HELP,CIC canceled my application before my landing |

My wife and I applied for canada immigration in 2003 when we were doing our master´s in canada. On 2004, I went to United States for my PhD program. As you can imagine, taking PhD in States and immigrating to Canada conflict with each other. The only possibility for me to get both of them is that I should finish my PhD and come back to canada in three years after my landing. This means I need to landing no early than 2006.
We did our body examination on June 2004 just before we came to United States. Then we submitted the PR fee this January. On Feb.20 2005, we received a letter from CIC to ask us to submit our passport for issuing PR visa. In the letter, it said "you must provide your passports to our office as soon as possible. Failure to do so could result in delays in processing." Actually, we don´t mind to delay. we didn´t submit our passport till today in order to delay our landing time. During this period, I faxed a letter to Canada embassy in Buffalo to ask them whether there any consequence for me to submit passport late, but I didn´t receive any reply.
Today, I received a letter from CIC says "your application has been withdrawn from the processing stream as you have not submitted your original passports, despite two request. A refund of Right of permanent residence fees will be processed with 12 weeks." I didn??t receive any request and I don??t know the consequence is so serious. I don´t know what to do now.
I know this is an unusual case. Is there anybody could give me some advices? Thank you.

Hi...you can try emailing this guy..he is an immigration lawyer..I think...but he really answers queries...

stupid, stupid and stupid. can´t you get your phd in canada? it would be more preferable for landing a job in canada with canadian education rather than us education.

You should know lot of peoples are waiting for PP request and hoping their name is called. I could imagine, when they got PP request, they burst in tears of joy, have party, etc...
This is what happening to you:
You have ignore CIC officer and now they ignore your application as well...

If CIC asks for something, send it to them.
They set the time frame not you. Don´t do things when they are convenient for you.
There is nothing you can do now.
I hope you have learned your lesson.

I hope you would have learnt your lesson. You want PR also but you also want to stay in US and not come back.
imagine situation of people in canada who has been waiting for long. I think you should contact lawyer. I see that you might have complications in your case as CIC will ask why you applied in canada, if you do not plan to stay..

Poor guy.
If I were you, I would try 2 things:
1. disscuss the case with a good immigration lawyer
2. Write to buffalo and give them some reasonable excuses. (Never say trying to delay the process by ignoring the PP request)
