Subject: Spouse Issues
  I need help guys with my wife´s application process. I rencently landed in Canada about 4 months ago. I was preparing to sponsor my spouse when I noticed in the document ation the following that I cannot sponsor someone who I did not include as a member of the family class when I submitted my pr application.

I applied for pr as a single person but got married and my immigration document was issued as a single person. I did not get married until february this year just before reloacting to canada.

What can I do to fix this requirement?

The other issue is that as at the time I landed, the immigration officer just asked me where I want my pr card sent and I gave him the address. It was later that I noticed that he did not register that I was married because I told him so. Could this affect my sponsoring my wife?

Sorry to tell you this but you made a HUGE mistake. It must have been clearly stated on the passport request letter that you MUST inform them if there has been any change in family composition. After the visa is issued you are not allowed to change your family composition (i.e. get married) before landing in Canada as PR.

No you can not sponsor your wife now. If you tell the immigration officials that you got married before landing in Canada as a PR and did not inform them they will cancel your PR.

You got lucky when you landed because if the immigration officer would have been more alert (i.e. realize that you got married and did not add your wife) s/he would have cancelled your PR.

I strongly recommend that you consult an immigration lawyer. I hope you can somehow bring your spouse to Canada.

you know what to do? Just go register again with your wife in another country and get a new marriage certificate with a date after the date of your landing. In other words, just pretend that you guys got married after becoming a Canadian PR.

Carol... this may work, but it may not.

You have to say on your application whether or not you have been married before... you also have to say when you were married, your spouse has to answer similar questions. They do background checks, and may look into why these people got married in a different country.

Try not to "pretend" things on your application, to try and fool CIC. If they find out, you may get into to a LOT of trouble.

I honestly think you need to talk to a lawyer about this one.

My husband married me to get canadian immigration. He has cheated me and abused my canadian citizenship. He out of the country now. Can I get his landed immigrant status cancelled?

Hi Caroline,

In life, timing is everything, I am afraid there is nothing much you can do at this point of time since he is already a landed immigrant and a FREE person. On top of this, if je goes on social welfare, you are on the hook for three years...

The only thing can happen to him, if het gets divorced from you, re-marry someone from back home, and immeidately sponsoers her, he may be called for (MOC) a marriage of convenience interview.

Now, yoou can only hope that he does everything quick so CIC have an obviouls reasons to believe to call him for a MOC interview and subsequently, if it is proved that he used you as a bait to come to Canada, he is definitely on the hook for the vacation of his PR status.

He has been out of Canada for five months now. Does his immigration status gets cancelled if he is away from Canadian soil for more than six months.
