Subject: Spousal Question
  Hi,

I know that my wife´s police clearance is good for 6 months.

What if I send the application to CIC-Miss, when the clearance is 5.5 months old, and they reject the application due to incompleteness or missing info, and I cannot get the forms back to them before the clearance expires.

Would my wife need a new police clearance, or would they kind of fix the date for when I first sent the application in?

I really need to know this because the clearance is from the FBI, and it takes us a long time to get a new one because neither of us live in the USA.

I would still send in the old one and at the same time try to get a new one. Somebody was able to get a new clearance in less than a month, what this person did was made a copy of the old clearance and attached a note stating he would like to get a new one. If Buffalo requests for an updated one, you can send it right away. You save time there ;)

Buffalo won´t ask me for an updated one, as mine is a spousal sponsorship, going to Missasauga, and with these cases, they just mail the whole thing back to you if you are missing information.

Dave: I had a similar situation as you. I applied with 4 months old police certificate and got cleared from Missisauga. THen my sponsership application was sent to local visa office in pakistan. When my file was opened for porcessing in pakistan the police certificate was already older then 6 months. SO the Canada visa office in pakistan has now requested my to provide an updated version of police certificate. I think in your case Missisauga office will not raise any issue. However, if you sponser is outside of Canada and file is to be processed from local office in your country. THere is a possibility that you will be asked to provide an updated one.

What?s up Dave?

You may send that police record , CIC will receive it.
It is going to expire during the whole process though , CIC may ask you to send a new one. As long as isn?t expire at the time you send the application , they won?t give it back to you for resubmission , if there is no missing info in the application.

My case is a funny one, and I think there is a reasonable chance that Miss may want more info. I think it will be OK in the end, but I want to find out before the end of the decade, if you catch my drift.

My wife lived in the US for a few years, and overstayed. I met her there (I was working under a TN VISA). We decided to follow a path that would lead her to Canada, so she moved back to Colombia, as we knew it is very difficult to immigrate from a place where you have no legal status.

I live with her in Colombia. But, I have to say I live in Canada, because I am under a tourist VISA. Hence, I am unemployed. Although they ask for some finacial info, I don´t have to pass the minimum income test. My Option C for 2004 is low, but I made a lot of money in Jan Feb March in 2005. It says to only provide paystubs if you must meet the min finacail requirements, and your Option C is too low. Do I send in the paystubs?? Who knows? They are scattered at my sisters in Canada.

I will have to say that I live with other people, as I am using my mothers address in Canada as my address. I will have to say that I live with my Mom and her boyfriend... although I have never actually stepped foot in their new house. I´ve never been to the address I will be using.

Anyway, there are lots of little wierd issues with my case that lead me to believe it may be delayed or sent back. I can´t call the CIC hotline as I am not in Canada. The Canadian embassy in COlombia does not take phone calls, and will only respond to immigration matters if you have a case number (which I don´t yet). Thats why I love this forum!!

Also, about the FBI check, I would find it rather frustrating if they ask me for an updated FBI check for my wife, as my wife has not stepped foot in the US for about a year, and cannot without a VISA; which she could never get because she overstayed... why would they want a new criminal check from a country that she has not been to since before the first cirminal check? I could understand them wanting an update on her Colombian record, but not the US one...

Well, I am sure eveyone here would love to hear me complain for hours on end! LOL!.

Well, I guess with the application its the same old storey... Hurry up and wait.

Sharon, How about this:

I have to give details about my jobs for the past 5 years.

I have had 10 employers! My longest stay was with a company for 2 years, and they gave me 3 T4s with different company names! (I laugh when the CIC forms give me 2 inches of space and tell me to use an additional sheet "if needed"!)

I have to give details about foriegn address:
I have 6 foreign address... 4 in the US, and 2 in Colombia over just 3 years (yet I am not sure if I was a resident on many of these). I had no lease agreement on any of these addresses. 2 places my company set me up with fellow co-workers, one I subletted on a hand shake agreement, two with wife (the lease was in her name), and one at my wife´s father´s house.

I worry, because sometimes I get confused with the details, and I can only imagine how the poor b&stard at CIC who first gets to look at my application is going to feel.
