Subject: I am an immigrant in U.S with no legal statu...
  I am an immigrant in U.S with no legal status. My visa and I-94 expired recently. I am planning to apply for Canadian Residency from U.S. How does my immigration status in U.S affect the Canadian Residency application?
Some suggested that it does not have anything to do with it as long as I entered U.S with legal status.

Your situation is very tricky because if you apply to CIC Buffalo they check the legal status of your stay in USA. They will ask you to provide papers to prove your stay in USA.It may be wise to apply from your home country.

You may wish to check with a Canadian immigration attorney. My partner was in your status, but the attorney we talked to said it would not be a problem. We are currently waiting for a PP request and it has not yet been an issue.

"Immigration Representatives

New Regulations for Paid Representatives
The new regulations state that paid representatives must be authorized:

in order to conduct business on behalf of clients when dealing with the Government of Canada in immigration and refugee matters
Authorized, paid representatives may only be:

immigration consultants who are members in good standing of the Canadian Society of Immigration Consultants;
lawyers who are members in good standing of a Canadian law society and students-at-law under their supervision; and
notaries who are members in good standing of the Chambre des notaires du Qu?bec and students-at-law under their supervision.
If you have an application or proceeding already underway as of April 13, 2004, you may continue to use the services of your paid representative until April 13, 2008.

After April 13, 2008, if your representative is not a member of one of the organizations listed above, you may choose to either continue unrepresented or to hire an authorized representative.

You are not obliged to hire a representative for immigration or refugee matters. The Government of Canada treats everyone equally, whether they use the services of a representative or not"

One thing I heard they may do, is request you for an interview in your home country, which would force you to leave the US in order to attend.

In addition, the CIC list residing in a country where you have no status as a source of a major delay in your processing.

Dear Dave,

I had interview in United States with same situation, I was asked about status in USA, I have told them, "I didn´t get sponsor because of job dwonturn". I had interview some time in October 2005, so certainly, that´s not ture. Moreover, I would like to tell you that according to new Form for SW, you must have to mantion your current Status of the country where you are at.

Rana,

My wife was in the US, on an overstayed VISA. I was hoping to sponsor her from there. Talking to immigration lawyers, and CIC hotline, my most common answer was that they would probably ask her to have her interview in her home country.
