Subject: Applying for canadian immigration
  Hi,
I am on H1B for about 2 years now and have a valid I-94. My visa however, has expired and have been asked to get it revalided from my home country.

I want to apply for canadian immigration under skilled worker program. My question is that can i apply from usa under my current status ?

Also I have taken IELTS back in May 2003. Can i submit that or I have to take it again?

Hi there,

I am sorry but i am gonna reply on ur second part of the question about IELTS, what is stated by them, they need an IELTS result issued within the last Six Months, so i dont think they will consider that one have done in 2003. i think it is better to take another exam so u will have a fresh result.

i believe that you would need to go back home and apply from there and then get a work permit/ employment authorisation and go to canada.
ilts are valid for one year after immigration receive them.
you need to re-take and get the high score as this will help with your points.

I would sayu just leave the US and be gone forever... You are illegal in the US right now. If the cops stop you for any reason, you will be arrested, prosecuted, detained and deported. Save yourself and the society the trouble of all these indignities and just leave... As far as Canada is considered, you may be better off in your poor country. Canada got a lot of crapshoot heads....

What is the heck you are talking about? I think you have nothing to do in this living world, and just giving somebody else bad impression about your darkness thought does not help most of the people here to seek to immigrate to Canada. If you do not have any interest in this issue, do not waste our time to read your stupid comments in this forum.

Ano,

Police cannot deport people in the US. Under no circumstance can a police officer demand that you prove you are a legal resident of the USA. They may ask for ID, but they cannot deport you. This type of thing falls under the federal government... the INS.

There are illegals in the US who have been arrested on minor charges, and released from jail.

I think I could not explain it properly. I am not illegal. My H1B is valid. It is the visa on my passport thats expired.

What I want to know is that can I apply with an expired visa?

Yes you can apply. Anyone who has been admitted to US for a period of more than 1 year can apply from US. Make sure you attach your H1 approval notice with your application.

Get your documents together and apply as soon as possible. The whole process can take anywhere from 19 to 32 months.

Yes you can apply from the US with an expired visa. THe visa is only a travel document to travel into the US. But if your H1B is valid you are legal in the USA and you can apply to Canada from USA.
