Subject: Work Permit/ Immigration
  Hi All,

I wonder if any of you can give me some directions regarding staying in Canada to work and applying for immigration.

I have been in Canadaas a student and then a worker for almost 7 years now. When I first
arrived I attended ESL classes and then some first year university
classes at a university college in BC. After that I
transferred to UBC to complete my Bachelor Degree in Food Science. I
finished my degree last May (2004) and has been working since.

I am now working at a dried fruit company in Summerland, BC as a QC/QA
and R&D Technologist, on my post graduation work permit which expires
in Oct 2005. So right now I am looking into renewing the work permit/
applying for immigration. I love this country and my job so I would
love to became a permanent resident here.

However, I am not sure how I should go about that. My boss and I have
looked into renewing my work permit (and I was planning to work on
applying for landed immigration after that). But we just found out
that to get a new work permit, we need an HRDC confirmation which has
to be positive. Also to get that HRDC confirmation, my employer has to
post a new advertisement for my position to prove that no one else
would be suitable for my job. This would be a huge pain for my
employer and myself.

Then we discovered there is something called Provincial Nomination. I
am not sure how this works for me and in terms of applying for
permanent residency. I am very confused and worried about my situation
because my current permit will expires in a few months and I do not
know how to go about all these.

It would be very much appreciated if anyone could give me some
suggestions, advices and options. Right now I am just plain confused
and it is in my mind every single day.

Thanks

Kit

Hi Kit, your employer must demonstrate that letting you go is going to adversely impact your company´s operations. Certification in a particular field also helps. In my case, we hired a lawyer to look over the materials we were sending to HRSDC. A well-written cover letter will also be useful. Make sure your position falls into the appropriate NOC category and the salary paid to you is comparable to the industry standards (not lower!).
It took us about 10 weeks to get HRSDC approval.
Sorry, no experience with provintial nominations, altough this may be a way to go.

visit the provincial website where you currently at, you´re very much qualified to have PR.

Hello,

Thank you all for your help! Hm...I just got my boss to briefly filled out the HRSDC form because I did not realize you need a lawyer to go over this kind of stuff. The only things I have dealt with so far is just the study permit and the post graduation work permit, so I thought that I could just work on the HRSDC on my own. Is that bad?
