Subject: Married a canadian and we want to move to canda
  Hi,

My wife is a Canadian Citizen and i am a Citizen of The Netherlands. We got married almost two years ago in Canada but we now live in Sweden.

We are planning to move to Canada and that means that i need to immigrate. How does it work?

I heard that the first year i can´t work and will not be insured.

We are planning to buy my father in laws business that i want to run, will this be a problem? or do i just still need to wait that year?

Hi George,

The fastest track for you is to apply from where you are now. If there are no complications, you should be done in 6 months to a year. It will take much longer if you go to Canada on a visitor visa and apply from there.

I don?t know where you are getting your information about not being able to work or be insured for a year after arriving as a PR. This is simply not true.

Thanks that makes me feel a bit better :-) doing nothing for a year would not be my idea of a good time.

But what kind of permit should i aply for?

You may apply for permanent residence to Canada from Sweden.
Your wife can sponsor you . It is safer and faster.

Faster because if the application doesn?t go through for any reason , you are allowed to appeal it nor in Canada.

And is faster.
Once your application is approved , you have to summit your passport and CIC will stamp your Immigrant visa and once you land in Canada , you can start working right away.

George, go to the site I listed in my previous post and read everything you can about FAMILY CLASS/SPOUSAL sponsorship. This is the fastest kind of sponsorship and it is the most appropriate one for your case.

All the forms can be downloaded and printed from the site. Make sure to gather as much evidence as you can find to support your relationship as authentic: Wedding photos, pictures of your travel together, photocopies of your entrance stamp to Canada, etc.

Your wife (sponsor) will have to provide proof that she intends to return to Canada as soon as you are granted PR status. Some examples of this are: written job offer from a prospective Canadian employer, Mortgage agreement for property, acceptance letter to an educational institution, etc.

Spend some extra time making sure to fill out the application package correctly leaving no blanks and not forgetting to sign all relevant areas. The smallest mistake often leads to the entire package being sent back to you for resubmission. This can add months to the process.

Some common reasons application forms are returned unprocessed are: Leaving spaces blank rather than writing NOT APPLICABLE, Forgetting to sign the back of a photo, incorrect photo specifications, leaving out one of many required signatures, Not putting a checkmark in a single box.

Some other factors that can result in delays include: not paying all fees, including landing fees, up front; leaving out any region specific forms; taking the medical exam too early so that it expires before processing is complete, providing ambiguous information that leads to being asked to elaborate or attending an interview.

Once you land in Canada as a Permanent Resident, you must apply for a Social Insurance Number (SIN). You may legally work once you receive this card. So, in reality, it may take a few weeks before you can actually work, but this is a far cry from a year.
