Subject: My baby's dad is US citizen
  I am currently 37 weeks pregnant, and the father and I have been together for two years now. We have been living together, going back and forth between canada and the us, but mostly residing in canada. I am not working right now as I am pregnant, and we are staying with my family in BC. He would like to be able to legally work here while I am nursing and caring for our newborn. We have been searching the internet on family and common law visas, but the information doesn´t say anything about a us citizen who is a parent to a canadian baby. As I am not working, I can´t sponsor him as a family member or a spouse. My mother and father would be more than happy to sponsor him, but I´m pretty sure the sponsor has to be a relative or spouse. I guess in-laws wouldn´t count as a relative? It just seems like he should be able to stay and work here as we´re having a baby together, but we can´t find ANY information to help us. Anyone who can help shed light on this matter, or who knows to whom I should direct my questions, we would really appreciate it. Only a few more weeks until the baby gets here, and we´re still at a standstill. We´ve got diapers to buy!

Hello Tara,

I don´t understand the problem here. If he is the father of your baby I presume u wud want to spend the rest of your life with him so why not go ahead and marry him. That way u sure can sponsor him as "spouse".

I´ve read that you must meet particular financial requirements before they will allow you to sponsor a relative or spouse. As i said in my first post, I´m not working right now due to my pregnancy, and will not be returning to work right away after baby is born. (Only three weeks to my due date), so I don´t meet those requirements.
I´m sure there have been us/canada babies before, so you´d think this would be a common enough situation for there to be some way to make this work.

Who can sponsor?
You may be eligible to sponsor if:

you have an income that is at least equal to the minimum necessary income, the amount of which is published yearly by the Canadian government.
You will have to provide us with documents that show your financial resources for the past 12 months and prove you are financially able to sponsor members of the family class. You may solicit the help of a co-signer (must be your spouse or common-law partner). If you reside in Quebec, see also Sponsors living in Quebec.

This condition does not apply if you are sponsoring only

your spouse, common-law or conjugal partner who has no dependent children, or
your spouse, common-law or conjugal partner whose dependent children have no children of their own, or
your dependent child who has no children of his or her own.


This is from cic website. So they say this condition does not apply if you are only sponsoring your spouse without dependent children or with dependent children until he still has not become a grandfather.
Where did you read about the income you should verify?

I read it on the government website, but I don´t remember seeing anything about how the financial conditions don´t apply if you are sponsoring a spouse. I´ll look further into that specifically - thanks a lot for bringing it to my attention.

you dont even need a job to sponsor him, as long as you are not on welfare and you are living with your parents.

Common law is the way to go IF you can prove that you have joint assets, proof of relationship, etc.
