Subject: Family class (parents) class action lawsuit
  It is apparent today that the processing times for parental sponsorship applications will exceed seven years. At some processing posts, applications will require a minimum of 10 years or more.

Richard Kurland, a well known immigration expert from Vancouver, is willing to take legal actions against CIC on the parental sponsorship matter. The basis of the claim is the breach of the Duty to Act. The applicants paid for a service that has not been delivered in a reasonable time frame.

This is the proposed plan:

1. Mr. Kurland is willing to file individual applications in Federal Court to pursue remedies in specific cases where there is merit to a request for relief in the form of mandamus. Later on, a class action will be commenced.

2. Most files will be eligible for a mandamus proceeding, but each file must be examined by the lawyer to ensure there is merit in following the mandamus route. The few files not eligible for mandamus will still be included in the proposed class action.

3. Individuals who are interested to participate will provide a non-refundable retainer of $350. This amount is inclusive of any and all applicable fees, taxes, disbursements and other costs of the litigation.

4. In the event the litigation is unsuccessful, the financial liability of the participant is limited to the non-refundable $350 amount mentioned in point 3.

5. The legal team for the class action includes some of the leading Canadian lawyers. The contact lawyer is Mr. Richard Kurland. The names of the additional lawyers will be revealed later.

6. Participants may reside in any Province in Canada. Participants will not be appearing in Court. Residence in Canada is not required to participate in the litigation.

7. Timeframes will be determined shortly.
