Subject: Immigration Procedure
  Hi,

I am a Canadian citizen male in his early 20´s and am interested in marrying a US citizen only to bring her back to Canada and start a life here. I would like to bring her to Canada and then settle here rather than go through the procedure in the States. I know according to Michigan law, the person has to be a minimum of 18 years of age and she is 17 at this time which is considered a minor by law on both sides of the border.

If she is to come across the border, what is the procedure for her to come from the States to Canada legally? Can she come across the border at the age of 17 with or without consent of parents? If not, what do I have to do in order to file proper paper work. One way is to wait a year til she is 18 and then bring her across the border deeming that the Customs officials don´t stop her from entering Canada as a visitor then I could apply for immigration for her as she would be married to me. Is there any other way?

I am not learned in the whole system as yourself and would appreciate some guidance.

Your advice would be very helpful.

Regards,

Greg

In order to sponsor her to come to Canada you have to be 18 years old or older.
I am not sure if she has to be over 18 yrs old though.
It would be easer if you guys wait until she becomes over 18 I would say.
I strongly recommend you to apply from abroad for her PR , applying from within Canada is a risky thing to do. If you guys apply for her Permanent residence and is denied for any reason , you won?t have the right to appeal and she might face a removal order from Canada.

It is faster and safer to apply from the U.S , if the application goes through , CIC will stamp on her Passport an Immigrant?s visa , so once she cross the border she will become a Permanent resident of Canada.
If the application is denied , you have the right to appeal the Immigration officer decision.

Check the official website for more information at:

I would say move to the US and find a job there, marry the girl, continue to work there while her paperwork crawls thru the CIC. Probably easier said than done.

Is it possible for her to visit Canada from the States and apply for permanent resident status from within Canada while staying here with me? Any risks in that?

I could marry her in the States and bring her back to Canada as a visitor while the immigration procedure takes its times.
