Subject: has anybody been in simmilar situation-sponsorship
  I live with my partner a year now and he decided to sponsor me in the family class - common law from within of Canada. We met online,and he visited me . Beeing living overseas it wasn´t possible to travel all the time . I finally came here on study permit , but unfortunately the extention was refused and I am out of the status now. We also made an appeal but don´t have any respond yet. I don´t want to leave them, my friend has children ,it would be very hard for them. I know it is possible to apply in this category ,the policy has changed ,but there´s no right to appeal.
I would like to know ,if anybody has been in a simmilar situation and was successful . thanks for any comments.

do you want the risky way... or the way with better chance of success?

riskiest way - do an in-canada common-law sponsorship. you will have to prove the relationship is genuine and not for immigration. your study permit refusal will make this difficult. if they refuse you... you will have no opportunity to appear.

risky... get married and do the above. there might be better optics on the relationship being genuine.

best risk... get married... leave the country and have your partner sponsor you. if they decline you, you have gained the right to appeal.

Another option is that you COULD apply Outside-Canada (at the visa office responsible for you country of nationality)...the only problem is that if an interview is required you would have to find a way to attend it, which would mean leaving Canada. And I´m not entirely sure about how your current status in Canada may affect an "Outside Canada" application.

As for your situation - depending on how much "proof" you have regarding your relationship (i.e - joint bank account, rental agreement, copies of emails/letters/phone bills, pictures from visits, letters from family and close friends who showing they´ve known about the relationship & it´s genuine, etc) it might not be that risky to apply In-Canada. However, if marriage is something that the two of you have talked about and are planning to do sometime in the near future anyways - like anonymous said you may want to consider getting married before applying.
