Subject: common law- requirements
My BF and I who is living together are planing to apply as an immigrant to canada through common law status. Please send me some information on how we can prove this status. We are planing to go together to canada... what are the proff need for a common law partnetship???

The following documents mey help you to prove your relationship:
Rent lease in both names,
Jointly banking account,
Statutory declaration of Common-law relationship, certified by a public notary,
Pictures together,
Letter from friends or family stating your relationship is a genuine one.
If you had a celebration party of your relationship, include some pictures of the party and if you had invitations, include one of them.
I hope this information can help you....If you have more questions you can go to LEGIT.Their meetings can be very helpful and they´re hold the last thursday of every month at 7:30 p.m.

Hi,
Thank you for your reply, it´s very clear. But we cannot provide the
Rent lease in both names, because we are both living with his auntie:)
Actually we are getting married next year, would it be possible if we
submit an application this month with the status commonlaw, and we will
just update it next year to married status??? How will we do it???
Since the application here takes arround 2-3 years, can we still update the
status into married the time we are wed??? I cant attend the meeting,
we are living in Philippines..

My Question is...are you both from the Philippines? you have to give me more details of this so i can answer your concern. I am an expert in immigration so feel free again to throw some questions. But you have to be specific.

the common-law union sponsorship under family class only applies to couples wherein the other partner is a canadian citizen, then that partner can sponsor his/her partner to become a permanent resident in canada. if both of u are from the same country, u apply as independent immigrants, if ur not married. at least, this is the way i understood it.

from my understanding, one of you will need to apply as a skilled worker if you have no existing family in Canada that can sponsor you. Inorder for your partner to be part of your application, you must prove, beyond any doubt, that they are your spouse/common law partner. So you might have 2 obstacles... having sufficient points to come as a skilled worker, and proving proof that your partner should be part of your application as your common law partner. I would see if you have the points to come first, then address the partner issue second. Good luck

thanks for the reply. Yes, my bf is the principal sponsor for skilled worker. Would the embassy require me also to submit my employment credentials (employment contract, employment certificate) even if I am not the principal sponsor??? please help:)

you must complete a IMM5406 and attach it to your own Schedule 1. you should include any job offer etc. (worth up to 5 points to the principal applicant) Common law is defined as ´living for a year or more with the principle applicant in a conjugal relationship´. They will ask for clear proof that you are not saying that you live together just so you have easy entry into Canada.

thanks for the information SHARON. Can we still update our status once we are married? We are planing to apply next month, and planing to get married next year, can we still update status from common-law to married once we get married??? How to do it??? thanks...

once you are given a file number, you can send them any changes to your marital status- in fact the application requires it. If you don´t they can deny your application. Make sure you send it by courier will a tracking receipt. we had to start our application all over again because they never got documents they requested.
