Hi there...my spouse is in Canada without status (nor can I get her status as she previously had a refugee claim that was abandoned a few years ago). From what I understand we will have to wait about 4 months AFTER we submit the application before I can get her Alberta Health Care. I´ve been told from Immigration that we could apply for visitor status in Buffalo, NY....then we may be able to get her Alberta Health Insurance. Problem is...she was denied a vistor visa 3 times previous when she apllied from her home country of Nigeria. This is somewhat important to me as my spouse is pregnant with our first child. Have any thoughts??? I am in the process of finding an Immigration Lawyer in Calgary (of which there are many).

She has to apply first to restore her status in Canada and then you can apply as her sponsor , if you are approved , CIC will continue processing your spouse PR from within Canada.

(in reply to: Sponsoring a spouse from within (health care)) How she entered Canada is not important. And a person does not need to have legal status to be sponsored. The minister changed the requirements on Feb. 18th of this year. I am seeing a lawyer this coming Tuesday. Apparently I can sponsor her and they will rush the case through on grounds of compassion.
