Subject: What to appeal after denial?
  Hi friends,

My friend was denied of PR visa after waiting for a long wait last Feb, the reason for denial was the lack of proof of english.."the Visa Officer ask my friend to provide IELTS result" and file an appeal for the case...but the Visa officer state that, submitting IELTS wont assure him the PR.

but he had self pitty and felt broke with what happen to his application after waiting for so long (48mos), it was about six months had passed since then... and now he´s strong enough to file an appeal.....but he doesn´t know how to start.

please help!!!!

Your friend had 48 months ( 4 years !! )to learn English and take the IELTS test.Why didn´t he just do that ?

thank you for your reply, actually alot of native english speaker can fail the IELTS test FYI. (band score of 7 and up)

After he secured the IELTS with a pass mark what should he do next? is theres a form or something that he needs to fill-up and has he had to pay a fee for this?

If his PR application was rejected he has to start all over again.By law, you have the right to appeal but in my humble opinion the chances of winning are very slim.

hopefully others wishing to avoid the hassles of IELTS will see this post. While IELTS does not guarantee you a PR, it insures that CIC give you proper credit for language skills.

Your friend made 2 bad decisions. 1) they did not include test results with original application 2) when it was requested... the request was ignored.

Your friend left CIC no choice but to decline his application. There are too many applications waiting in line for CIC to play sorry with your friend. I am guessing he will be forced to start his application again. Hopefully this time he will take the CIC requirements more seriously.

Sharon, yes your very true he avoided IELTS to save money, and just submitted documentation to support his english, such as his degree was taught in english etc... i think he had a bad CIC case officer, hence the officer should contact the applicant and ask him to provide IELTS otherwise the decission will be make on docs at hand.

he was given a chance to provide IELTS. I am sure he was also given a deadline to do so. Probably 120 days. There is no bad luck involved here. It was very bad economics on his part. He will still need to do the IELTS for a new application plus he is out 4 years and $550.

I have another word for it rather than bad luck.
