Subject: Class action lawsuit commenced
  It is apparent that the processing period for many parental applications will exceed seven years. At some processing posts, those applications will require a minimum of 10 years or more, prior to parents or grandparents receiving an immigrant visa.

A class action has been commenced before the Federal Court. Among the allegations, we have alleged that immigration authorities knew or ought to have known that no services whatsoever would be provided to process applications for permanent resident visas for parents and grandparents prior to the determination of the "Sponsor Applications"; that immigration authorities failed to provide their Services promptly upon receipt of such Fees, or alternatively, within a reasonable period of time following receipt of such Fees; and, that immigration authorities procured Advance Fees from the Plaintiff Class of approximately $50 million for immigration applications that did not exist when the Advance Fees were paid and for which no Services whatsoever were provided.

We are of the view that there is an obligation to process immigration applications related to the immigration of parents and grandparents within a reasonable time.

We are taking measures we believe appropriate that will encourage the Government of Canada to recognize its obligations, and reduce the processing times for parents and grandparents.

Beginning from August 22, 2005 there will be individual applications for judicial review seeking relief in the form of mandamus prepared for submission to the Federal Court.

We are aware that immigration authorities have requested many sponsors to effectively re-do their sponsorship applications. That situation is currently under review.

Individuals who are interested to join the class action and the mandamus, can still do it.
