Subject: Please Help !!
  Hey all, first of all sorry for my englsih.

So i married a Canadian girl on aug26, but my student visa expires on aug31. Im going to aplay for landed immigrant but its going to take some time (a week) before i´ll have all the documents that i need. Tomorrow is going to be Sept. 1 so im going to be illegal here. What should i do ?, should i go to migration and talk to them or maybe should i wait till i´ll get all the documents and then apply for landed immigrant. Im so scare cause i was thinking that i still have 2 more months.

according to "new policy from February 18, 2005(http://www.cic.gc.ca/english/applications/spouse.html)" i understood that i shouldnt be wary cause if im in marraige i can applay even when my visa is expired. But im not sure if my understanding is good.

anyone can help me ??

Honestly, I don´t know what to say. You should have renewed your visa 30 days before it expired. I know that if you´re applying for a second visa you can also apply for "restoration of status" in the same application and pay the required fee. But if you´re applying for PR and you are without status, you might be in a sticky situation.

This is my opinion but please research it before you decide to put it into play. This is just a suggestion and I dont really know the logistics of a spousal application. But the first thing is to restore your status, so I suggest you apply for a visitor visa for tourism purposes. Most students are granted this very easily once their student visas expire. You´ll have to mention that you stayed beyond the validity of your visa and provide some excuse (I dont know what but you´ll have to think up something). Once you get your visitor visa you can begin to apply for your PR. That way when your application for PR goes in, you´ll have status in Canada. Hope this helps. Oh I just read that news release from Volpe. I don´t really know if he is saying "if your spouse or partner is in the country even though he/she is here without status you can apply for PR." It´s unclear. My suggestion is to call the CIC hotline to get a clearer picture.

Hi Peter:
Please disregard everything I just said. Phew* I found more information on the topic and I believe you ARE right. Good news! You CAN apply from within Canada even though you have lost your status. But you are not permitted to apply for study or work permits while your application for PR is in progress. So there you go. Mystery solved. Sorry for scaring you a little with my first post, but I wasn´t aware of the change in policy. The frequently asked questions page of the cic website is quite useful if you haven´t already seen it.

well Peter...

I don´t want to look pessimistic...but RARE are the successful similar cases...

I haven´t met a guy who married a canadian girl and applied for PR and had a good time or easy time getting his PR....marrying a canadian is not the way to run away from renewing your visa...

Anonymous - im not trying to run away from renewing my visa, i married her cause i love her, we´ve been togeather for 2 yeras.
