Subject: Big Problem... 2 week DEADLINE!!! HELP!!!
  Ok, here´s the story, I´m American, my fiance is Canadian. I have been visiting in Canada for a couple months. I went home to help my folks out with some work. On my way back in I requested a visitor record to aid in family class Immigration. They said, ´no way are you getting that for a few months´ They said I would probably not return to the USA. Now here is the clincher, they would only give me a visitor record good for 2 WEEKS!!! Which means I have to be back in the USA by then.

I talked to the Immigrations lady, at the border, and she said the only way I could come back in for an extended period of time is if I were married. I said ´Ok, what if I brought proof of marriage to the border next time I go to enter´. She said if I bring that to the border and show them they will give me a YEAR VISITOR RECORD. Is this correct, or a lie??? We are thinking about eloping in the USA (can receive Marriage certificate same day). Now if we go to the border together, after we are married and have the certificate will they actually follow through with what she said and give me a year visitor visa to apply for PR or will they deny me entry? I always thought that would be DUAL INTENT, guess not???

I am REALLY FREAKED OUT about the whole thing... PLEASE PLEASE PLEASE HELP ME, I am desperate.

Hi there, I totall understand how you are feeling right now as I have been in the same boat. I cam across the border and they issed a two week visa. When I got into canada I applied for an extension to that two week visa (on the grounds of duel intent and compassionate grounds as my common-law and step daughter live in Canada). This extension was refused (they think you are going to stay in Canada). I then hired a lawyer and he is appealing this through the Fedeal Court.

I applied for immigration and now I am stuck again as they have requested confirmation that I have left Canada´, before they will continue processing my application.

I am writing to tell you this as I do not wish you to end up in the same situation as me, which is right now being forced with the decision of going back to London, Uk and waiting for my application to be completed there.

I have heard of getting married as a solution to this, and have heard of people who are married indeed being given a year visitor´s visa (but you cant work etc until you have your PR Card).

I will contact my lawyer in Toronto and ask him if what the immigration officer advised you is indeed correct and we will both be fine!

I´ll keep you informed and let you know asap when I hear something about this.
