Subject: US Grren Card and Canada PR card
  Hi All

I have US grrencard and my US citizen Oath will be next week. I am also landed Canadian Immigrant...landed on August 05, 2005 with my family and kids. Changed my driving lincence from US to Ontario, Canada and bought car in Canada....I faced some serious issue yesterday while crossing Windso (Canada)-Detroit (US) Tunnel. At US immigration I showed my green card to enter into US. The officer asked me that why I am driving a car bearing Ontario licence plate. I told I am Canadain PR too and real trouble start. I was taken to their office and asked me which residency I want to keep, US or Canada. I was so upset. I also told them that I have US citizenship Oath this monday. After one hour or so they returned all my documents including my PP, US green card and Canadian PR card.
To my surprise when I came home in the evening I had two phone messages from US immigration asking me to contact via phone and call back #s are also left as part of the message. These numbers are from Detroit region. I am going to call them this morning/afternoon.

My urgent questions are :

If I give up Canadian PR what will happen to my wife´s and kids´ PR as I am the principal applicant for them? Will they loose their PR status too?

If I give up US green card then I can not go to Detroit(US) to work still living in Windsor(Canada). My idea in settling down in Windsor is only for this reason that I can go for work in the US.

Please help me.

U.S. is very strict!!!

I would still go for the oath taking ... in the U.S. ... they don´t have control over your Canadian PR ... even though you say you´ll give that up ...

Or ... give up the U.S. oath taking all together and stay in Canada ... just get a working VISA .. for you to be able to work in the U.S. .... I am assuming you guys like Canada more .. as your family is there ..

Also get an opinion of an immigration lawyer ... because you are threading on borderline immigration laws .. surely they have reasons why you should be holding just one PR..

But honestly .. I envy you ... I would rather have your problem .. than be waiting for the U.S. greencard and Canadian PR at the same time ..

Consult an Immigration Lawyer immediately before facing the immigration officials in Detroit. You must go for U.S. Citizen oath, dont give that up., you made some mistakes while crossing the border otherwise i know many people who are successfully managing both citizenships......good luck...the only relaible advice you can get at this time is from IMMIGRATION LAWYER...take this matter seriously.....this forum is of no help to you in this matter...good luck

My advice to you is not to try to kill two birds with one stone. You are one of the few lucky guys amongst us who has the opportuinity to end up either as a US or Canadian citizen. You need to seat yourself down and serious think about your goals/expectations in life and then make a final decision as to which country offers you the best opportuinities.

I totally agree with Dennis. You have some major soul searching to do. If you want to live in Canada, you should probably decide to work there as well and make it your home. Otherwise, if your job in Detroit is more important to you, take the US Citizenship oath and settle down in the US. The US does not recognize dual citizenships; as the so-called president says: "you´re either with us or against us". Granted, you are not yet Canadian citizen; however, if in 3 years after getting Canadian PR you decide to become one (Canadian citizen), you´d have to give up your US citizenship at that point. It is possible to work in one country and live in the other, and you do not have to be a US citizen to do so. But surely there are other issues here for you to deal with, and a lawyer will be your best bet in figuring out what steps to take next. Good luck to you.

Sorry but you are wrong. US does recognize dual citizenships. My kids are dual US and Canadian citizens and I will be dual US and Canadian citizen when I fulfill my Canadian residency requirement. It may be different becuase I am a natural born US citizen.

i agree GB...
my kids have 2 citizenship also. they even didn´t have any problem to get US passports because they were born in the US. It may be a problem if a non-US born citizen becoming a canadian citizen at the same time. unless you don´t tell them what´s the fact. a natural born US citizen has US birth certificate which will always be a proof of citizenship.

I apologize if I´m incorrect, but my understanding is that some countries (perhaps Canada is one of them, I´m not sure) do recognize dual citizenships, but that the US stopped recognizing that some years ago. Of course US born persons are US citizens, unless they choose (at 18 or 21) to become a citizen of another country. My mother had to give up her citizenship of the country where she was born when she took the US Citizenship oath, and friends who refuse to give up their citizenships from other countries are not allowed to gain US citizenship unless they do. Children are given until they are adults to make a decision, and thus, they can be dual citizens until that time. There have been periods where the US did recognize dual citizenships, and I have friends who do hold dual citizenship as a result of being grandfathered in to that rule. But my understanding is that this is no longer the situation for new cases. I certainly don´t mean to provide incorrect information, but this has always been my understanding. I guess I´m of the belief that a certain amount of loyalty ought to be in play when deciding where to live and hold citizenship anyway, and I for one can´t imagine looking back on giving up my own US citizenship if I get the opportunity to gain Canadian.

My 2 kids aren´t US born citizens but Canadian born. Since I´m a US citizen we have a certificate of birth born abroad for both kids. I´ve already looked into becoming a dual citizen for myself and I won´t have to give up my US citizenship; therefore, I´ll become a dual citizen.
