Subject: divorce
  My wife and i have agreed to a divorce we have been seperated for 2 weeks and have agreed to divorce. I had sponsored my wife from india and agreed to be responsible for her for ten years, does this mean that once i get divorced i will still have to look after her financially? If so when does this stop? We have been married three years and she only recently came to canada (5 months). I feel she was planning to divorce me once here. Please help, advice needed

Runku, you are financially responsible for you wife for 10 years. If she receives social assistance you will have to repay the monies that she received during the 10 year period from the day she finalized her immigration process, ie. from when she arrived in Canada.

Just another note, while your wife can sponsor a spouse immediately you will have to wait 3 years before you can sponsor another spouse.

thankyou for your message ... another thing if my wife is the one filing for divorce why should i have to be responsible for her still? i fidn this not fiar at all.. Also what if i get married and again or vice versa .. do i still pay her for 10 years im finding this so hard to believe.. Ilike i said b4 i find this whole marriage sutuation a sham on her side. What if i tell immigration this was her plan to come to the country and divorce me?

The duration is 3 years in case the sponsored person is a spouse.

When you sponsored your wife you signed a contract (Sponsorship Agreement) with the Canadian govt that you will support your wife financially for a period of 3 years. It is very clearly mentioned on that this agreement is unconditional and can not be terminated under any circumstances.

So even after you divorce your wife you will have to support her. If she claims social assistance you will have to pay the government. If you violate this agreement then you will not be able to sponsor anyone in the future.

sorry can i just make this clear... i am only responsible for my wife for 3 years after divorce or 10? please confirm.. and does anyone have an idea of how much it normally costs. i know she will rinse me out completely.. . I know i made an agreement and man do i regret it! Im sure something can be done to ppl like my wife who come in to the country, live for 3 months here and decide to divorce? Cant i shop her to immigration ?

She is a PR of Canada now and you can not do anything about that. You mentioned in your first post that you have been married for 3 years so no one will believe that she married you just to immigrate to Canada.

The duration of the sponsorship agreement starts from the day your spouse became PR of Canada. So if she landed in Canada as a PR in April 2005 you are obligated to support her till April 2008.

Read the sponsorship agreement and you will get a very good idea about your responsibilities as a sponsor.

Runku, you would only be financially responsible for her while she´s living in Canada. If she returns to India and tries to hit you up for money, she will have to do it through the court system in her jurisdiction.

I would seriously get a lawyer if I were you. It might cost you some money, but it might cost you more in the long run if you don´t.

I´m hearing about this more and more often, and the whole thing escapes me. You´ve been married for 3 years and she just got around to joining you here now? Did you have NO indication?
