Subject: Visitor Visa = Temp. resident? and spouse sponsor
Hello, just wondering if my partner visits Canada from the UK, is he considered a temporary resident? Reason being, if he were to stay, and extend his ´temporary residency´ so I could sponsor him as my spouse. Also , does anyone know if I can sponsor my partner as a conjugal partner and give immigration a date we plan to marry, or do we have to get married first?

Thanks!

Conjugal sponsorship is proving to be very difficult. I have yet to hear of a successful application. I would recommend marrying him unless you can put together a 1 year common law defense.

It states in the CIC guide that Conjugal partners are not finance like or for applicants whoo are going to get married. Conjugal sponsorship is used for applications who cannot get married because of some legal limitations.
I have read of successful cases, but in one case the PR applicant could not get a divorce because in her country they had to be seperated for two years before they could file for a divorce.

I can´t comment on the TR issue, I am confused by it myself. What we call visitor´s visa is included under TRV and include temporary resident permits. I believe you partner would be on a visitor´s visa and will be considered a visitor rather than a temporary resident. I read information on this on the CIC website under manuals and procedures you can check out the information for confirmation.
