Subject: proving real marriage
My husband and I recently married and are ready to apply for his immigration to Canada. There is one problem: a major difference in our ages. What can we do to prove our marriage is real ? if the visa is refused, can we take this to court under the charge of age discrimination ?

You can take to court anything you want but the problem is to win. If you got married that is your proof, you don´t need to prove it with anything else. Your guy will be in Canada.

Julia,
There is no reason to be worried. The fact that you guys are married is the only one of paramount importance. When you got married did you legalize the marriage at the place where you got married. Even if you did not, I think you can apply for a legal document like a marriage certificate etc issued from the city where you got married, and this should be the only proof needed to prove your marriage.

it´s not as easy as you might think. On another message board a woman wrote about the problem of proving marriage validity. They refused her husband because they hadn´t lived together, even though this was impossible because she had a job in Canada she couldn´t give up and a son to support. We talked and she said to get a lawyer, which we did, and to live there a while longer with him, which we also did. Also got testimonies from neighbors and friends.

Hi Julia.

I agree with you that this application, as with all others, should not be taken lightly. Nor should you assume that a single document (i.e., a marriage certificate, in this case), will overcome all objections and/or concerns.

Too often, I see people making posts on this (and other) forums, asking how to do one thing or another. The answers, while usually pretty good, often overlook some important point of law. Provided that this legal point does not arise in the applicant´s processing, everything turns out well. However, we have seen hundreds (thousands???) of posts on this site wherein applicants are being denied or delayed due to some oversight they´ve made. What´s worse is that they often blame CIC for their problems, which they probably could have avoided had they sought professional advice.

If, for example, your spouse is ineligible to work in Canada until his/her application is either approved or approved in principal, don´t you think it makes good economic sense to spend $1000.00 to ensure that the application is processed without delays? After all, a two month delay in processing will delay his or her commencement of income by the same timeframe. In my opinion, this is the same as tripping over dollars to pick-up dimes...

Now don´t get me wrong - I´m not suggesting that Julia (or anyone else, for that matter) spend $2,000, $3,000 or $4,000 in professional services on a straightforward spousal sponsorship. But why not hire someone to atleast "audit" your application prior to its submission? These types of services are available for as little as $400.00. That´s only one week´s pay, at a measly $10.00 per hour!!!

If you choose to do it yourself, and then run into problems with CIC because they are not satisfied with your application, please remember that the extra time and effort required on your behalf is a result of the "money saved" when applying alone. Please don´t blame CIC.

To prove the marriage you will need the marriage certificate, many photos from the ceremony, perhaps some letters from friends, photos of you with your spouse before the marriage showing you have been together in a relationship for some time. If you have joint accounts or anything like that, those will help in proving the relationship.

If you are refused you will have a chance to appeal if you chose to do so and if you fall under the right category to appeal. CHECK the CIC web site for details.

You asked about going to court for AGE discrimination. You are jumping the gun a bit. Just send as much proof as you can and be patient.....CIC can be a long process sometimes.

And do not follow advice of people who say being married is proof enough...it is NOT....ask TACHOUR and many others...she spent THREE years trying to be with her husband. YOU need to show them that your marriage/relationshiop is true without any doubt.

If you think all this is too much, then you should think twice about immigrating. It is a process full of rules that seem unfair but they are rules. You can´t come into this process thinking you can change them. Be aware of the rules and then you will not be disappointed.

I wish you luck! All will be OK if you follw the rules and fill out everything correctly. You do not need a consultant if you can follow instructions and check and double check and triple check all documents.

Don´t be afraid to ask questions here....most people will help while others will give you trouble.

We have everything it´s possible to collect as evidence and in fact, thanks to this inhumane process, we have spent our whole marriage looking at each experience together as possible proof when in fact we just wanted to put all this bureaucratic **&%!!! out of our minds and just glory in our happiness being together. Thanks to CIC our beginnings and what should have been so beautiful were tainted by this haunting refrain at the back of our minds " get proof, get proof or the dream of bringing him to a clean healthy country will disappear"

i jst want to ask u..as 2 years before i was refused by canadian immigration for study permit as i failed to satisfy the visa officer...and nw after few months im going to marry a girl who is canadian citizen..will my previous refusal will create some problem for me in my case.??
Pls let me knw im very much scared..
