Subject: Apllied from India, now in USA.........
  Guys, I applied for immigration to Canada under skilled worker class, from India in April 2005, and received my file no. in June 2005. After that I have come to USA on a 3 year assignment on L-1 visa. What should I do ? Should simply I write to Canadian Consulate in New Delhi that my residential address is now so and so in USA, or should I request them to transfer my file to USA (as it would be processed much faster here !) Which would be the best alternative ? Please advice,

If you are sure that you will stay in USA for at least 3 years I suggest you write a letter to Canadian Consulate in New Delhi to transfer your file to Buffalo, USA. But it is upto the immigration official in New Delhi to transfer your file. Also I dont know how much time they will take to do the transfer and if Buffalo will treat your appication as a new file.

Another option is to withdraw your application from New Delhi and submit a fresh application in Buffalo. But here you will loose the application fee you sent to New Delhi.

Please keep in mind that if your file is transfered to USA and you are called for an interview( say 2 years down the line) it is your responsibility to attend the interview in USA.

You have to be in the USA for atleast 1 year before you can apply in Buffalo, this is to the best of my knowledge
you might want to confirm it.

Hi Brian,

The rule is that an applicant has to be "admitted" into US or Canada for a period of more than 1 year to be able to apply from Buffalo, USA.

Thanks Brian and Kenny, Would you give me another opinion ? I scored a band of 8 in IELTS, have 10 years of expereince in a very reputed company which is a house-hold name in India, and scored over 76 marks in my self-assessment for immigration. What are the chances that my interview may be waived ? Additionally, what are the general conditions which result in interview wiaver for a particular candidate ?
