Subject: Canadien Immigration - Arranged Employment
  I have a company and my brother in law would like to migrate to canada. Can I as an employer provide him with employment opportunity for him to get points?

What consiquences do we (me and hime) have if he comes and doesn´t want to work for me or I fire him. Or if he decides to go to school after he arrives?

Hi Jhave.

Depending upon the nature of the company (i.e its corporate size, volume of sales, historical reputation, etc.), as well as your relation to its HR department, such offers of employment may succeed, providing they are deemed as "bona fide" by Human Resources Development Canada (HRDC). In conclusion, if you own the company, and/or are in charge of hiring, it is unlikely that HRDC will see this as a bona fide offer. However, there may be no harm in trying.

As for what happens after your brother-in-law settles in Canada, he, like all other Canadians, would be protected by the Charter of Rights and Freedoms. However, if HRDC or CIC learned of false and/or misleading statements and claims made in conjunction with his application, either of you may be subject to penalty (including his removal of permanent resident status and deportation).
