Subject: How to postpone the Landing ? Visa extension ?
  I applied Canadian PR as skilled worker (Buffalo office) and now they´re asking for my passport for visa stamp. The immigrant visa placed in the passport shows expiry date. They say this date can not be extended. I did the medical exam on may 2004 so most likely the visa will have expiry date of may 2005. I am in the US now and I really can not go to Canada to claim my PR that early (may 2005). I just changed job and my H1 approval has not come out, it can easily be 1 year from now. and since my US visa has expired I need to go back to my country and apply to US visa there. very complicated and dangerous process. visa rejection is not uncommon. don´t get it wrong I will migrate to canada but I don´t intend to migrate right away (probably end 2005 or mid 2006)

1) I must get an extension. is it possible to do that. how can I do it? do I need a lawyer?

2) if I can not extend it then what is my alternative ? ?? they say that if I fail to enter Canada before the date I have to re-apply and submit a new application and processing fee. - if I have to re-apply will be easier or harder? will it be faster or slower? is there any chance that I might get rejected? do I have to re-do the whole thing in doing the new application or can I just fill out some simple form and they can refer /use my old data/credentials?

From my understanding, you have to enter before the deadline, if you fail to enter then you may have to go through the entire PR application process again.

Best will be to firdt apply for about 2-3 weeks leave, take the visa, enter Canada, register with the appropriate bodies, get the PR card and return to your US work. If you want to be even quicker, locate a friend and then give his address for the PR card to be delivered. You do not have to be in Canada after you register, you are free to move.

Don´t miss the deadline, is my advice.

is the visa expiration totally NON-NEGOTIABLE ? Iron clad unbreakable? Can I go to court to get the extension ? I have not submit my passport ( I must do that in..the next 20 days), so probably when I submit it I can ask them to give me a longer expiration date? I don´t mind if I have to redo the medical exam.

Visa expiration can´t be extended and it is based upon the one year validity of your medicals or the expiry date of your passport whichever comes first.

Hi

I just received approval from the CIC and so they asked me to send in my passport and will have a deadline for landing on the visa. The problem is that I did my first medical exam at the end of November 2003 ( though my final results were sent in in mid Jan ) so I dont think I can mail in the passport and get it back before end November. Do you know what happens in this case ( the letter of approval is dated Oct 28th, so there is no way I could have done all this before the end of November. )
