Hi,
I have been in US for 10+ years and have been a LPR of US for about 3 years now. I have been recently charged with domestic assault. My wife called cops out of anger and frustration and they were required to charge me by law. My wife did not want me to be arrested and did not want me to get charged, she had some injury but she agrees those happened while I was trying to defend myself while she pushed me. We have 2 kids- 4 year old son and 1 year old daughter, both US citizens.
I have hired a criminal attorney to present the self-defense case to the court. The prosecutor has been informed by my wife that the police report is not accurate and that she is the one who was the aggressor. The prosecutor has agreed to offer Disorderly Conduct plea even before the pre-trial date. But even a disorderly conduct can be grounds for deportation?I am hoping for dismissal or acquittal upon trial.
If the worst case scenario materializes, I will be deported. I am wondering if I will be eligible to apply for Canadian immigration. The background paperwork asks if the applicant has been charged/convicted, which is true for me. I do not have any prior charges/convictions in US or any other country. I am a qualified skilled worker with 8+ years of experience. Should I apply for Canadian immigration? Do they reject all cases where the background cases indicate any criminal charges/convictions??

I would suggest that you sort out the charges etc before you attempt your application. My guess is that CIC is looking for reasons to say no... not reasons to say yes and a criminal charge is not in your favour. Timing might be everything.

Aydine and Shervin Dargahi have been living in Iran for the past 3 years and now they are getting their Canadian passports. This is a vilolation of the law.

The people are losing their moral while becoming modern. The society needs to be attentive that moral values. Well things needs to be modernized but keeping intact with moral values.I hope you will find your solution.Don´t bring law between family!!!!!
