Subject: Help please!!
I am a Canadian citizen and my husband is American. We currently live in th usa and are trying to move to Canada... Can we move to Canada while the forms are being processed? We got the medical done, the FBI security clearance done, and all the forms filled out. Before we sent all the forms off. So do we have to wait to hear back from CIC or can we move while they are being processed? And what is the general timeline for sponsorship and Permanent res.?

Carrie, you may stay as a visitor in Canada for up to six months at a time. While here as a visitor, you do not have a legal right to work. Have you already submitted your application package? Your time line depends on what type of application you are making, but you are looking at about a year for processing.

Hi.

If Carrie is a Canadian Citizen, then she WILL have a legal right to work, study, etc. in Canada. It is her Husband who will have to wait before enjoying these benefits.

That said, Carrie and her husband should consider making a "with-in Canada" application for spousal sponsorship. It may not be as quick as the outside Canada process, but her husband may be eligible for a work permit in roughly 6 months... Also, it could save the expense of having to return to the US for an immigration interview.

Carrie, if you are interested, please consider contacting our office to assist with the application. If nothing else, it´s a good idea to have your application package audited prior to its submission with the Canadian authorities. Check out www.e-ca.ca or www.crarerlaw.com for more info, or call the office at 1.403.516.6123.

BTW: If Carrie and her husband intend to move to Canada with all of their household items in their immediate possession (i.e., towing a trailer, or via rental truck), the Canadian immigration authorities at the POE may have some issues with her husband "coming to Canada to live" whilst requesting a visitor´s visa to enter (keep in mind that visiotrs should have the intention and ability to leave the country).
