Subject: temp resident visa & spousal sponsorship
  My fiance is coming to Canada from the UK as a visitor and does not require a temporary resident visa. (He can come visit for up to 6 months without a visa, being from the UK). We plan to marry within his first few months in Canada and then apply to extend stay (his ´temporary resident visa´) and I will apply to sponsor him as my spouse to stay and live in Canada as a permanent resident.

Is there a minimum amount of time he needs to be considered ´living´ in canada with me, before I apply to sponsor him? In other words,Will a 6 month ´temporary resident visa´ suffice?

Since he does not technically need a ´temporary resident visa´ to visit Canada, he will not have any paperwork to submit when we want to extend his ´visit´. Does anyone know how we go through this process without ´temporary resident visa´ documentation?

if you go to www.cic.gc.ca and go to applications and forms there is a section with the extension of stay in canada that you will need to fill out and send it. the guide will tell you everything you´ve asked in your post.

If you are planning to sponsor him as a common law partner (unmarried) he will have needed to live with you for 12 consecutive months before applying. if you marry, then there is no set time requirement for him to have lived with you. again, on the CIC website, under applications and forms, since you plan to do an INCANADA application, click on PR application and in that there is also the sponsorship forms. he will not be able to work or study until he receives initial approval from CIC however.

You´ll have to have 2x 6 month visitor´s visas just to get to the amount of time you need to sponsor (12 months). When you apply for the extension at the end of his 6 monts it is HIGHLY unlikely they will grant it if you say, "we´re waiting for the 12 months to pass to apply for PR". You need a lot of proof of funds and so on. On top of that you will need at least another 6 month visa after the 12 months because inland PR takes about 7 months (and rising) to process. So your fiance would not be able to work for at least 18 months. The only way around this is to go on a BUNAC visa (www.bunac.org) if he is younger than about 35.
I strongly recommend you apply to London as it takes much less time and you wouldn´t have to worry about him not earning while you wait. You could even go to the UK while you wait, either as a visitor or on a BUNAC visa yourself.

The plane tickets from UK to Canada are already bought (round trip just in case), date of wedding already planned within his first 6 months, with enough time to apply for extention of ´temp resident visa´. We already know the timeline for application processing, and that he cannot work until Approval in Principal is received. We are taking the risks because we cannot live apart any longer. We have also already looked at the BUNAC option, and that way does not work for us.

My question was more regarding actual documentation for ´temporary resident visa´ status, since he doesn´t need one to visit Canada as a British Citizen. When he applies to extend his ´visit´ he will not have any paperwork for a ´temporary resident visa´.

From what I understood as well, is that if I am applying to sponsor him as my spouse (after we marry) and he applies for permanent residency (all from within Canada)that extending his ´temporary resident visa´ should not be a problem.

Anyone have any info or help on this?

Okay, I think I get it. Just photocopy his passport stamp and info. page and explain that he was admitted under the 6 month visa waiver program as he is British. They won´t have any problems with that.

Out of interest, can I ask why not? Is it due to age?

No the age is not a problem. The BUNAC program actually looks quite good as well, however, it takes 4-6 weeks to hear anything after you apply and you must send your passport with your application. For 2006 entry to Canada you can apply as early as Late November/early december. BUT.... then he cannot come to Canada for Christmas, because he won´t have his visa yet, or his passport back.

Also first entry to Canada for the 2006 BUNAC program is not until Mid February!! That is just too long for us, we have already spent too much time apart!

I am on a temporary resident visa, which was applied for in Canada to come to the UK. I´ve been here for 3 months, & lived in Canada for 3 years but am not a Canadaian Citizen. I am a South African citizen. I would like to visit family in Canada next month..Would i need to apply for a holiday visa? Even though im on a multiple entry visa?...
I´ve heard that because I applied for it in Canada to come to the U.K I´d have to apply for on In the U.K to go to Canada? Please any additional information would be helpful! thanks in advance.

I have my canada PR ,i came to India once my PR process is complete.Now i need to search a job once i land in canada.Meanwhile i want to get my wife to canada .Can anyone let me know the ways to get her to Canada,is it better to apply TRV outside /inside canada.
Do i need to show my job and paystubs for her visa petition.Is it mandatory to show my financial status for a temporary resident visit visa?
