No visa for ´stiff´ looking NRI couple

[ Tuesday, November 08, 2005 04:59:26 pmPTI ]

TORONTO: Immigration authorities in Canada have allegedly pooh-poohed an NRI´s marriage, refusing to grant his wife citizenship because the pair look too "stiff" in some wedding pictures to be a real couple.

Singh married his second wife Ranjit in November 2002 in India and ever since, he claims, he has been trying to bring her to Canada and the Federal Immigration Department have been persistently refusing to grant her citizenship, the Vancouver Sun daily quoted Singh as saying.

"Your marriage is not genuine and was entered into primarily for the purpose of acquiring permanent residence in Canada," Singh´s 2005 rejection letter states.

The pair, a rejection letter signed by a High Commission official in Delhi said, "do not depict the comfort level that is visible in photographs of a married couple. You (Ranjit) and (Singh) look distant and aloof in the photographs."

A widower for the last three years, 55-year-old Singh claims he married 36-year-old Ranjit in front of 150 people in India after courtship and applied for her to join him in Canada as soon as he returned.

But she has been repeatedly rejected by Canadian officials, who say the marriage is a sham, the Sun said.

Singh said he has spent more than USD 50,000 on legal bills and trips to Punjab to be with his wife over the last three years.

"Why would someone do that if it is not real?" Singh, a mill worker by profession, said adding "I am willing to put up a bond to support her for 10 years if necessary. She will not be a burden to Canada."

If this is true, then its really sad. I really don´t buy into the argument of "in the interest of Canadians", its a bunch of baloney. The cold and hard fact is that, the best that the western (developed) world can do to identify the fraud cases is to generalize them into categories.
Whats given is that, immigrants are trying to get in, so they have to suffer - its the bottomline. Every nation is entitled to put forth stupid arguments to prevent someone from entering into it, but this one takes the cake, maybe Mr. Singh should show some stiff pics from his bedroom !!

That is funny Raj!

However, the Candian Immigration program is now mature and they ought to have better standards and measure to clear applications, for e.g. the US program.

They have levels - back ground check on your qualification is done "before" medicals. I have absolutely no reservations on that part, as a matter they should to only get the right candidate in, but they should structure the process better.

There are applicants who get PR in 18 months and then there are who are waiting in 24 months. The difference between applications after medicals should be between the validity period of 1 year.

Now we have so many on this forum who have passed that 1 year mark.

marriage (in reply to: No visa for 'stiff' looking NRI couple!!)
Simply getting married should be enough. There are a million and one reasons for marriage, I don´t think the government should be poking around the motivations and determining what is "genuine" marriage. As long as they are not a threat to national security--let them in.

Tim, do you have any idea how many marriages of convenience come in to Canada? far too many - even with the current rules and screening. More often than not, the sponsored spouse does not have language or work skills to be self-sustaining in Canada- they just think it is going to be easier in Canada and they can live on $8. Let them in... no thank you! I am tired of paying the bills.

I like the US system where a married spouse has to remain married for 2 years after landing to gain residency.

defintion of marriage (in reply to: No visa for 'stiff' looking NRI couple!!)
Who are you to define marriage? I think a willingness enter the legal contract of marriage is all the government should require. Otherwise, how do you draw the line on what is real marriage? The stiffness test? Age? Intent to have children? I prefer the government staying out of relationships.
