Subject: Misrepresentation
  Dear All,

This is a response to all the replies I got for my query on "misrepresentation". If you remember, I had a medical condition which I couldnt reveal to my spouse, as a result of which I didnt inform CIC while my PR application was in process.

Thanks for all your replies. I did notice one of you and Sharon discussing the pros and cons of hiding details from the CIC.

Well, just to clarify, I did not reveal my medical condition to my spouse, BUT I DID TELL CIC about it. They conducted additional medical checks and then cleared me. I just wasnt sure whether they would clear me or not when I got married, so I didnt tell them about my wedding. If I had told them, I would have had to add my spouse´s details onto my application. And thereafter, if I had been rejected on medical grounds, obviously I would have had to explain why to my spouse. I was cured when I got married, and because of the lack of awareness in the general public about my condition, my doctors told me it would be in my best interest not to tell my spouse-to-be about my medical history.

Anyway, right now I´m going crazy trying to find a solution to this. My intention wasnt to cheat anyone. I´ve lived in Australia before and I know several people having sham marriages just to get their visas. I dont think I´ve committed a sin to now face being kicked out of here.

We are not the ones whome you should come clean with. Your wife is the one who deserves truth and only she will absolve you of your guilt.

Ok great, you told CIC about the condition and they cleared you. No problem.

As for the marriage follow my advice in your other post. Get a new marriage certificate dated after you landed. Don´t worry about Sharons comments about legal stuff, she isn´t thinking clearly on this one.

Don´t stress so much. Its not like you have killed someone.

Your first priority should be to get your wife with you. As suggested, consult a lawyer for this.

Once she is with you, it is personal to you have to decide, but in my view you should make up for all she has gone through.

I think Sharon is the only one thinking clearly here.

Hiding illness from a spouse...not clear thinking.
Not informing CIC about a marriage....not clear thinking.
Getting a marriage certificate dated after landing....not clear thinking.

Come clean....tell your wife. Tell CIC. Do the right thing!

Case summary:

Application prepared by myself and sent for Federal Skilled Worker Class at Buffalo .

Here?s the timeline for the PR application:

Application Sent: May 31, 2007
Acknowledgement of Receipt Received: June 2007
Application Processing Started: 29th June 2007
IELTS Requested: July 2007
IELTS Taken: 25th August 2007
Results Submitted: September 13, 2007
Initial Assessment letter Received: January 14, 2008
Interview Required: January 14, 2008 (application placed in queue)
Interview Date: April 15, 2008
Interview Outcome: Case rejected on grounds of misrepresentation and forged educational documents.

Education background: Post graduate certificate course in corporate communication and public relations, Canada ? 2004-2005
P.G. Diploma in Mass Communication (Correspondence course) ? 2002-2003
M.Sc. in Biophysics Honors 1999-2001
B.Sc. in Biophysics Honors 1996-1999

Current Status: HRSDC approved Work Permit; Valid until September 2008

First entry to Canada : August 26, 2004: Study Permit for 8-month certificate course. All the documents were shown at the time of admission to the college. However, as advised by the agent, M.Sc. Honors Biophysics and P.G. Diploma in Mass Communication were not disclosed in the visa file. My part time experience from 1999-2002 was converted to full time experience and shown instead. I received the study visa to pursue the study in Canada . I have copy of the student visa file.

Misrepresentation: In the application for PR that I submitted I have attached all my educational documents and work experience certificates with employer recommendations. Immigration officer asked me specifically why Masters was not shown when you applied for student visa. She told me that I have hidden the material facts to gain an entry into Canada and hence misrepresented the file. The education was hidden because I knew I wouldn?t have got the student visa otherwise. She informed me that since you have hidden information and you are liable for misrepresentation under the immigration law. I informed her that I had filed my case through an agent and I submitted all the documents to the agent and I am not aware how this has happened.

Forged educational documents: She asked why there are different roll numbers on different transcripts. She said in her career as an Immigration Officer this is the first case she has seen where the roll numbers are different on different transcripts and told me that my education is forged. I tried to explain to her that in India , every year we are given different roll number while appearing for examination. She said you are lying and told me to go read more about Indian education system. I had taken a letter from my department in the university after I was called for an interview clarifying that I was a student there. That didn?t seem to convince her either. I told her I have all the originals I can show you. She plainly refused. Said I don?t care what originals you have and I don?t care what letter you are showing me. How do I know these original looking documents are not forged? Why did u take a letter from department now? Why you didn?t submit it at the time of application. I don?t know if you have signed or stamped this yourself.

She informed me that she is refusing my case and has cancelled all points for education and said that she will talk to the program manager and put charges of forgery and misrepresentation of information against me. She told me that she will ensure that I am barred from applying for PR for another 2 years for this reason.

She looked at my work permit and said well I suggest that you return back to your country after the completion because I am going to make sure that your stay be not extended.

I do not have any correspondence from CIC yet but I will appreciate if you could tell me after reviewing my case if I stand a chance for appealing the charges against me.

why do people insist on lying and then ask everyone to help them figure out a way to fix it?

Why is nobody willing to take responsibility for their actions. You screwed up, you made CIC out to be an idiot and now you want them to feel sorry for you?

The officer is right in pointing out the issue of misrepresentation (you hiding your Masters degrees), you messed up bad there....

As far as the roll numbers are concerned.... do you have 2 roll numbers for the same transcript ? I´m confused.... I know you may get different roll numbers for 2 years, but thats for your examination attempts right ? Please shed more light on that.

In any case, it seems like you are in their black books now, I think you need a good attorney who can fight your appeal case. That agent that you hired the first time.... was that a CIC approved agent, if yes, then I think there might be a glimmer of hope..... sorry to take up the last post, you will have to open a Part 2 on this one if you wish.
